No public testimony was <br />received other than the applicant's. The council closed the public record, and had several additional <br />questions for staff. Staff responses are provided in the attached memorandum, dated February 20, 2007. <br /> <br />The proposed zone change is being reviewed concurrently with the proposed Metro Plan amendment. <br />When the City considers a zone change concurrently with a Metro Plan amendment, the City is to use <br />the applicable procedures for the Metro Plan amendment (EC 9.7305). In accordance with the single <br />jurisdiction Metro Plan amendment procedures, the City Council's decision on the request must be based <br />on the record created before the Planning Commission; no new evidence is allowed at the council <br />hearing (E.C. 9.7735(4)). Councilors who were not present for the public hearing may review the record <br />in the agenda packet for the November 20, 2006, public hearing. <br /> <br />Eugene Code requires that the City Council take action on a proposed Metro Plan amendment within 30 <br />days of the public hearing, which, for this request, would have required action by December 20, 2006. <br />However, at the request of the applicant, council action on this item was postponed to allow staff and the <br />applicant an opportunity to discuss the questions posed by the council.
