ADMINISTRATIVE ORDER NO.21-20-14 <br />of the <br />City Manager of the City of Eugene, Oregon <br />TERMINATING THE STATE OF EMERGENCY DECLARED BY <br />ADMINISTRATIVE ORDER NO. 21-20-09 UNDER SECTION 2.1055 OF <br />THE EUGENE CODE, 1971 WITHIN THE CITY OF EUGENE, OREGON, <br />DUE TO THE MAY 29-30, 2020, RIOT AND CIVIL DISTURBANCE IN <br />THE DOWNTOWN AREA. <br />The City Manager Pro Tem of the City of Eugene finds that: <br />A. Section 2.1055 of the Eugene Code, 1971 ("EC"), provides that the City Manager <br />may declare a state of emergency when an emergency requires a coordinated response beyond that <br />which occurs routinely, the required response is not achievable solely with the added resources <br />acquired through mutual aid or cooperative assistance agreements, and the emergency consists of <br />a Level 3 emergency under the city's emergency management plan. <br />B. On the evening of Friday, May 29, 2020, some people within a crowd of <br />approximately 200 that had gathered in downtown Eugene began committing acts of vandalism, <br />lighting fires, and damaging buildings, businesses, and city property. As the crowd moved around <br />the downtown area, the riotous activities escalated and there was increased vandalism and <br />destruction, including spray painting of LTD buses, aerial fireworks thrown into buildings and <br />parked cars, to include the Lane County Jail building, throwing of rocks and bottles, breaking of <br />windows, looting, and blocking traffic. Local business and city property was destroyed. There <br />was a very large bonfire with flames 20 feet into the air at a parking lot at 7th and Washington. <br />C. At approximately 12:30 a.m. on May 30, 2020, the situation became more <br />dangerous, with reports of people being hit by fireworks and other life -safety issues. The Eugene <br />Police Department (EPD), after making announcements to allow people to leave area, deployed <br />gas to disperse the crowd. A crowd of more than 50 people re -gathered and a second fire was <br />started on Lawrence St. Due to businesses at the 7th and Washington complex, including Five <br />Guys, Jimmy Johns, T-Mobile and Starbucks being destroyed, with the windows broken out and <br />looters entering some of the businesses, EPD deployed its SWAT, assisted by the Springfield <br />Police Department and Lane County Sheriff's Office. There were also reports of subjects inside <br />Buy 2 at 110 W. Broadway, as well as looting at Hunky Dory and Level Up Arcade, shattered <br />glass at Firehorse, and reports of crimes at other business locations. At approximately 2:15 a.m., <br />EPD again deployed gas to push the crowds out and try to get them to disperse. <br />D. On May 30, 2020, after contacting the Mayor and each City Councilor and <br />receiving their input about declaring a state of emergency due to riot and civil disturbance <br />described in Paragraphs B and C, the City Manager Pro Tem executed Administrative Order No. <br />21-20-09 declaring a state of emergency as defined in EC 2.0155 within the geographic boundaries <br />of the City of Eugene. <br />Administrative Order - Page 1 of 2 <br />
