NOW, THEREFORE, <br />The Planning Division Director of the Planning & Development Department orders and <br />directs that: <br />1. The above findings are adopted. <br />2. The Principal Planner and Senior Planners in the Land Use Planning section, as <br />well as the Senior Planner (Land Use Supervisor) in the Building & Permit Services Division are <br />hereby delegated the authority to carry out the Planning Director's duties and responsibilities under <br />the Eugene Code, 1971, (EC), as well as all duties and responsibilities delegated to the Planning <br />Director by Administrative Order No. 53-20-06. These delegated duties and responsibilities <br />include, but are not limited to the authority to: <br />a. Receive requests for extraterritorial water service extensions, sewer service <br />extensions, or provision of water or sewer service to special service districts, upon <br />a finding of compliance with EC 2.212; <br />b. Execute, on behalf of the City, agreements required to be executed in connection <br />with annexations, including any notices of such agreements, modifications of the <br />agreements, or other documents required by the agreements to be subsequently <br />executed; <br />c. Render Type I and Type II decisions (EC 9.7100-9.7120 and 9.7200-9.7230); <br />d. Render Land Use Code and Decision Interpretations (EC 9.0040); <br />e. Render Zone Verification decisions (EC 9.1080); <br />f. Sign and date approved partition and subdivision plats (EC 9.8245 and 9.8570); <br />and <br />g. Execute performance agreements on behalf of the City (EC 9.7025). <br />3. Upon a finding that it would be more efficient and in the public interest to do so, <br />any of the duties and responsibilities delegated herein may in tum be sub-delegated to such person <br />or persons considered qualified to perform the duties or assume the responsibilities. <br />4. The delegation of authority contained herein shall be construed to extend to and <br />include any person(s) "acting in capacity" (AIC) for the persons to whom authority is delegated. <br />5. Nothing contained herein shall be construed in any way to limit or impair the <br />Planning Director's authority to perform any of the Planning Director's duties or responsibilities, <br />whether delegated herein or not. <br />Administrative Order --Page 2 of 3
