Tethering. Restraining a domestic animal by tying the domestic animal to any object or structure <br />by any means. Does not include using a handheld leash for the purpose of walking a domestic <br />animal. <br />Section 3. Subsections (2) and (3) of Section 4.340 of the Eugene Code, 1971, are <br />amended to provide as follows: <br />4.340 Animal Neglect. <br /> <br />(2) Animal neglect in the second degree. A person commits the offense of animal neglect in <br />the second degree if, except as otherwise authorized by law, the person intentionally, <br />knowingly, recklessly or with criminal negligence: <br /> <br />(a) Fails to provide minimum care for an animal in such person’s custody or control; or <br /> <br />(b) Tethers a domestic animal in the person’s custody or control and the tethering <br />results in physical injury to the domestic animal. <br /> <br />(3) Animal neglect in the first degree. A person commits the offense of animal neglect in the <br />first degree if, except as otherwise authorized by law, the person intentionally, knowingly, <br />recklessly or with criminal negligence: <br /> <br />(a) Fails to provide minimum care for an animal in the person’s custody or control and <br />the failure to provide care results in serious physical injury or death to the animal; or <br /> <br />(b) Tethers a domestic animal in the person’s custody or control and the tethering <br />results in serious physical injury or death to the domestic animal. <br /> <br />Section 4. Section 4.731 of the Eugene Code, 1971, including the Section title, is <br />amended to provide as follows: <br />4.731 Bias Crime in the Second Degree. <br /> <br />(1) A person commits a bias crime in the second degree if the person: <br /> <br />(a) Tampers or interferes with property, having no right to do so nor reasonable ground <br />to believe that the person has such right, with the intent to cause substantial inconvenience <br />to another because of the person’s perception of the other person’s unhoused status, race, <br />color, religion, national origin, disability, gender identity or sexual orientation; <br /> <br />(b) Intentionally subjects another person to offensive physical contact because of the <br />person’s perception of the other person’s unhoused status, race, color, religion, national <br />origin, disability, gender identity or sexual orientation; or <br /> <br />(c) Intentionally, because of the person’s perception of unhoused status, race, color, <br />religion, national origin, disability, gender identity or sexual orientation of another person or <br />of a member of the other person’s family, subjects such other person to alarm by <br />threatening: <br /> <br />Ordinance - Page 2 of 5 <br /> <br />
