ORDINANCE No. 19808 <br />AN ORDINANCE CONCERNING LOW-INCOME SUBSIDY PROGRAM <br />LOCAL IMROVEMENT ASSESSMENTS; AMENDING SECTION <br />7.175 OF THE EUGENE CODE, 1971; AND DECLARING AN <br />EFFECTIVE DATE. <br />THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: <br />Section 1. Subsection ~ 1 } of Section 1.115 i s amended by rel etteri ng <br />the existing subparagraphs (c) and (d) to (d) and (e), and adding new langu- <br />age and anew subparagraph ~c} thereto, to provide: <br />7.175 Local Im rovements - A ortionment of Assessments. <br />~1} whatever share of the total estimated or actual project costs <br />of the local improvement i s to be borne by the city and others shal l be de- <br />ducted from the total project costs before they are apportioned and assessed <br />under this section. The city shall pay all or part of the cysts of the <br />following, provided funds are available and the project has appropriate pri- <br />ority: <br />~a} Extra capacity constructed in the improvement to serve <br />areas beyond the improvement district; <br />~ b} Paving and sidewalks within the intersection of publ i c <br />ways which costs may a1 so be paid by assessing the abutting public <br />way•. <br />s <br />~c} Street and alley improvements for residentially zoned <br />property upon which a single family dwelling or duplex exists <br />which is owned by low-moderate income persons} and which property <br />is adjacent to a local street or alley which is unimproved or im- <br />proved with substandard improvements at the time the local improve- <br />ment district is farmed. <br />~d} Storm sewers constructed as part of a street improve- <br />ment project within existing developed areas; <br />fie} Other costs attributable to special conditions yr to <br />policies adopted prior to or at the time the counci 1 adopts the <br />resolution forming the local improvement district. <br />Section ~. The City Retarder, at the request of, or with the concur- <br />rence of the City Attorney, is authorized to administratively correct any <br />reference errors contained herein or i n other provisions of the Eugene Cade, <br />1911, to the provisions added, amended or repealed herein. <br />Section 3. This Ordinance shall become effective six months from the <br />Ordinance - 1 <br />
