I ~ $1 l~ <br />AN ORDINANCE AUTHORIZING THE INSTITUTION OF PROCEEDINGS <br />IN EMINENT DOMAIN FOR THE ACQUISITION OF PROPERTY <br />INTERESTS ALONG BOGART LANE AND BAILEY LANE FROM <br />WILLAKENZIE ROAD TO LUELLA STREET, FUR THE PURPOSES OF <br />CONSTRUCTION OF STREET IMPROVEMENT5; AND DECLARING AN <br />EMERGENCY. <br />The City Council of the City of Eugene finds that: <br />The City Council has authority under provisions of the City Charter and <br />applicable state 1 aw to institute proceedings i n eminent domain far the acqui s i <br />tion of private praperty for public purposes, including the improvement of city <br />streets and construction of curbs, gutters, sidewalks, and other features. <br />The City of Eugene is in the process of improving city streets and an <br />March 4, 1991, the City Counci 1 enacted Resat uti on No. 4234 initiating the Bogart <br />Lane and Bai 1 ey Lane Improvement Project from Wi 11 akenzi a to Lue11 a Street, which <br />includes street improvements consisting of paving, curbs, gutters, sidewalks <br />and storm sewer improvements. <br />The proposed improvements shall be in compliance with, and in furtheran- <br />ce of, the plans and speci f i cati ans to be prepared by the City Engineer i n <br />accordance with provisions of Chapter 1 of the Eugene Cade, 1911, and appl i cabl e <br />policies of the City of Eugene. <br />The streets to be improved were original 1 y designated as public ways under <br />Lane County's jurisdiction when the adjacent property was used agriculturally. <br />Although the width of the public way was inadequate for urban development, urban <br />development has occurred on the adjacent properties. That development now <br />necessitates widening and improving the public way to serve the adjacent property <br />and surrounding neighborhood. <br />It is not in the public interest to significantly relocate the historic <br />public way to provide access to this established neighborhood.
