<br />AN ORDINANCE GRANTING TD THE BURLINGTON NORTHERN RAILROAD COMPANY, A
<br />DELAWARE CORPORATION, ITS SUCCESSORS AND ASSIGNS, THE FRANCHISE TO MAIN-
<br />TAIN ITS RAILWAY TRACKS OVER CERTAIN STREETS IN THE CITY OF EUGENE, AND
<br />TO OPERATE TRAINS AND CARS THEREOVER, AND TO TRANSPORT PASSENGERS,
<br />FREIGHT, MAIL, BAGGAGE, AND EXPRESS THEREON, AND TO MAINTAIN ITS PRESENT
<br />POLES AND WIRES OVER CERTAIN STREETS IN THE CITY OF EUGENE, OREGON.
<br />THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS:
<br />Section 1. That there be and hereby is granted to BURLINGTON NORTHERN
<br />RAILROAD COMPANY, a Delaware corpvrativn, its successors and assigns, the
<br />franchise and right to lay, construct, and maintain its present tracks and
<br />its present sidings, switches, curves, and connections, and to operate and
<br />run trains and cars thereaver, and to transport passengers, freight, mail,
<br />baggage, and express thereon, subject to the following restrictions and upon
<br />the following named streets and places in the City of Eugene, Oregon, T4 WIT:
<br />Across all intervening streets southerly and easterly of the intersec-
<br />tion of the right-of-way of the BURLINGTON NORTHERN RAILROAD COMPANY and
<br />the northern city limits of the City of Eugene, and extending southeast-
<br />erly to the easterly line of the intersection of Grant Street and 5th
<br />Avenue, including the crossings of Grant Street, Garfield Street,
<br />Roosevelt Boulevard, Side Street, Bethel Drive and Prairie Road.
<br />Together with the right and privilege of maintaining and reconstructing~on
<br />all the streets above described, such wyes, frogs, switches, curves, and
<br />connections, as said BURLINGTON NORTHERN RAILROAD COMPANY, its successors and
<br />assigns may deem necessary or convenient in the maintenance or replacement of

<br />its present equipment, without in anywise extending the same. And that there
<br />be and there is hereby also granted to said BURLINGTON NORTHERN RAILROAD
<br />COMPANY, its successors and assigns, the right tv re-erect, reconstruct, and
<br />maintain poles, wires, and other necessary and convenient equipment for the
<br />purpose of preserving and maintaining its present equipment for conveying
<br />power and electrical current for its awn use, all upon the streets heretofore
<br />
