Administrative Order - Page 1 of 12 <br />ADMINISTRATIVE ORDER NO. 53-22-09-F <br />of the <br />City Manager of the City of Eugene <br /> <br />AMENDING AND REPLACING MULTIPLE-UNIT HOUSING <br />PROPERTY TAX EXEMPTION RULE R-2.945 ADOPTED BY <br />ADMINISTRATIVE ORDER NO. 53-21-05-F. <br /> <br />The City Manager of the City of Eugene finds that: <br /> <br />A. Pursuant to the authority contained in Section 2.019 of the Eugene Code, 1971, the <br />City Manager has adopted Multiple-Unit Housing Property Tax Exemption Rule R-2.945 (“the <br />Rule”). The most recent changes to the Rule were adopted on July 21, 2021, by Administrative <br />Order No. 53-21-05-F. <br /> <br />B. On October 24, 2022, Ordinance No. 20675 was passed by the City Council <br />amending Section 2.946 of the Eugene Code, 1971 to replace references to “Oregon Zero Energy <br />Ready Commercial Code” with “Oregon Energy Efficiency Specialty Code” in response to the <br />Oregon Building Codes Division’s adoption of the new Oregon Energy Efficiency Specialty Code <br />which replaced the Oregon Zero Energy Ready Commercial Code. <br /> <br />C. On November 17, 2022, I issued Administrative Order No. 53-22-09 ordering that <br />notice be given of the opportunity to submit written comments on a proposal to amend the Rule so <br />that so that the Rule aligns with the amendment made to Section 2.946 of the Eugene Code by <br />Ordinance No. 20675. <br /> <br />D. Notice of the proposed amendments to the Rule was given by making copies of the <br />Notice available to any person who had requested such notice and by publication of the Notice in <br />the Register Guard newspaper on November 28, 29, and 30, and December 1 and 2, 2022, <br />providing interested persons an opportunity to submit comments on the proposed amendments <br />until the end of the day on December 13, 2022. No comments concerning the proposed Rule <br />amendments were submitted within the time or in the manner set out in the Notice. <br /> <br /> <br />On the basis of these findings, I order that: <br /> <br />1. Multiple-Unit Housing Property Tax Exemption Rule R-2.945 is amended by <br />updating Rule R-2.945-C. <br /> <br />2. The unamended provisions of Multiple-Unit Housing Property Tax Exemption <br />Rule R-2.945 adopted by Administrative Order No. 53-21-05-F are reaffirmed and incorporated <br />into the Multiple-Unit Housing Property Tax Exemption Rule R-2.945 adopted by this Order. <br /> <br />3. Administrative Order No. 53-21-05-F is superseded by this Administrative Order <br />No. 53-22-09-F as of the effective date of this Order.
