Administrative Order -- Page 1 of 2 <br />ADMINISTRATIVE ORDER NO. 53-23-01 <br />of the <br />City Manager <br /> <br /> <br />EMERGENCY AMENDMENT OF REGULATIONS FOR ADMINISTRATION <br />AND ENFORCEMENT OF THE BUILDING, FIRE AND TECHNICAL CODES <br />ADMINISTRATIVE RULE R-8.005 ADOPTED BY ADMINISTRATIVE ORDER <br />NO. 53-17-01-F. <br /> <br /> <br />The City Manager of the City of Eugene finds that: <br /> <br />A. Pursuant to the authority contained in Section 2.019 and subsection (6) of Section 8.005 of <br />the Eugene Code, 1971 (EC), Regulations for Administration and Enforcement of the Building, Fire and <br />Technical Codes Administrative Rule R-8.005 was adopted by Administrative Order No. 53-17-01-F on <br />February 28, 2017. <br /> <br />B. EC 2.019(6) authorizes the City Manager to adopt emergency rules that adopt, amend, or <br />suspend a Rule without prior notice or hearing. <br /> <br />C. Due to economic factors and other challenges effecting development, it is necessary to <br />adopt an emergency amendment to Administrative Rule R-8.005 to grant additional time for building permit <br />applicants to complete the process of obtaining their permits. <br /> <br />D. High construction material costs, financing costs, market uncertainty, supply-chain issues <br />in critical industries, and availability of contractors and subcontractors have greatly increased the risks <br />associated with development and caused permit applicants to reanalyze and delay moving forward with <br />their projects. <br /> <br />E. A failure to adopt this amendment promptly will result in serious prejudice to Eugene <br />property owners and those in the building trades who are temporarily unable to move forward with building <br />permit applications as they originally intended within the timeline described in the Administrative Rule <br />because, without this amendment, those parties would be required to go through a costly reapplication <br />process. Providing additional extension requests will allow housing and other permits related to economic <br />recovery to remain viable. <br /> <br /> <br />NOW, THERFORE, based upon the above findings and pursuant to the authority in subsection <br />(6) of Section 2.019 of the Eugene Code, 1971, I order that the amendment to Section 4.6.1 of Rule R - <br />8.005-B shown in legislative format below shall become effective immediately and remain in effect for a <br />period of 180 days from the date this Order is signed unless replaced earlier by an emergency rule, <br />temporary rule, or permanent rule adopted in accordance with the provisions of Section 2.019 of the Eugene <br />Code, 1971.
