<br />RESOLUTION NO. 4634 <br /> <br />A RESOLUTION ESTABLISHING HAZARDOUS <br />SUBST ANCE USER FEES FOR THE FISCAL YEAR <br />COMMENCING JULY 1, 2000. <br /> <br />The City Council of the City of Eugene finds that: <br /> <br />A. Pursuant to Article VII of Amendment IV to the Eugene Charter of 1976 (the <br />"Amendment"), the City Council has previously adopted Resolution No. 4587 establishing fees to <br />be paid by hazardous substance users within the City for the 1999 fiscal year. <br /> <br />B. In accordance with other requirements of the Amendment, Ordinance No. 20188 <br />adopting the 2000 Hazardous Substance Tracking Instructions was adopted by the Council and <br />approved by the Mayor on February 28, 2000. <br /> <br />C. As a result of decisions of the Court of Appeals and Circuit Court in litigation <br />involving the Amendment, the City revised the method of calculating the hazardous substance user <br />fees. Section 3.694 of the Eugene Code, 1971 which was adopted on February 28, 2000 by <br />Ordinance No. 20189, imposes a fee upon hazardous substance users in an amount per FTE to be <br />established by resolution of the Council and paid annually, no later than May I of each year. That <br />section further provides that the first fee due under that section was to be paid by May I, 2000, or <br />within 30 days of the date the City mails an invoice setting forth the amount due, whichever is later. <br /> <br />D. The Toxics Board has recommended a fee of $14.31 per FTE be imposed for the <br />fiscal year commencing July 1, 2000 in order to cover the expenses of the program for that fiscal <br />year. Issues surrounding a shortage or surplus of funds at the end of the fiscal year will be addressed <br />equitably for all participating hazardous substance users, in accordance with generally accepted <br />accounting procedures. <br /> <br />NOW, THEREFORE, <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EUGENE, a <br />Municipal Corporation of the State of Oregon, as follows: <br /> <br />Section 1. A fee of $14.31 per FTE is hereby imposed as the fee to be paid by hazardous <br />substance users within the City of Eugene for the fiscal year commencing July I, 2000. The fee shall <br />be due and payable within 30 days of the date the City mails an invoice to a hazardous substance <br />user setting forth the amount due. <br /> <br />Resolution - 1 <br />
