ORDINANCE NU. X0163 <br />AN ORDINANCE CONCERNING 1 % FUR ART IN PUBLIC <br />PLACES, AND AMENDING SECTIONS 2.638 AND 2.640 OF <br />THE EUGENE CUDE,1971. <br />THE CITY OF EUGENE DUES ORDAIN AS FOLLOWS: <br />Section 1. The definition of "Public place" in Section 2.638 of the Eugene Code,1971, is <br />amended to provide: <br />2.638 Definitions. For purposes of sections 2.638 to 2.648 of this Code, the following <br />words and phrases mean: <br />Public glace. Any building, park, mall, or ather capital construction prof ect <br />abut not including streets, alleys, bicycle paths, and other public thoroughfares} <br />constructed, remodeled, or purchased by the city which construction, remodeling or <br />purchasing involves the expenditure of more than $50,000. As used herein, <br />"remodeled" or "remodeling" includes modifications andlor additions to existing <br />facilities, but does not include projects that are necessary in order to preserve, <br />maintain, or repair existing facilities. <br />Section 2. Section 2.640 of the Eugene Code,1971, is amended to provide: <br />2.640 Fund for Art in Public Places Established. There is hereby created a special fund <br />to be used to make provisions for works of art in public places and improvements <br />awned by the city. One percent ~ 1 %} of all funds for construction, remodeling, or purchasing of <br />public places hereafter authorized by the city, except for funds used to purchase land without <br />improvements or land with improvements that are unrelated to the reason for the purchase, shall be <br />appropriated and deposited into this fund. <br />Section 3, The City Recorder, at the request of, or with the concurrence of the City Attorney, <br />is authorized to administratively correct any reference errors contained herein or in other provisions <br />of the Eugene Code,1971, to the provisions added, amended or repealed herein. <br />Passed by the City Council this <br />26th day of July,1999 <br />City Recorder <br />Ordinance <br />Approved by the Mayor this <br />
