<br />ADMINISTRATIVE ORDER NO. 58-01-18-F <br />of the <br />City Manager of the City of Eugene <br /> <br />AMENDMENT OF FEES FOR RIGHT-OF-WAY CUT <br />PERMITS AND REPEAL OF ADMINISTRATIVE ORDER NO. <br />58-97-09-F.- <br /> <br />The City Manager of the City of Eugene finds as follows: <br /> <br />A. Section 2.020 of the Eugene Code, 1971 authorizes the City Manager to determine <br />and set fees and charges to be imposed by the City for services, goods, use of municipal property, <br />and licenses and permits. In accordance with the procedures set forth therein, and the further <br />authority of Section 7.300 of the Eugene Code, 1971, Administrative Order No. 58-97-09-F was <br />adopted on June 26, 1997, establishing right-of-way use permit fees. A portion of the fee schedule <br />adopted by Administrative Order No. 58-97-09-F was subsequently amended and is incorporated in <br />the fee schedule adopted by Administrative Order No. 53-01-07-F. This order amends the fees not <br />included in the schedule attached to Administrative Order No. 53-01-07-F. <br /> <br />B. In accordance with the procedures set forth in paragraph A above, on December 23, <br />2001, I notified the Mayor and City Council that I intended to rename Right-of- Way Cut Permit Fees <br />to Utility Right-of-Way Use Permit Fees and amend those fees, to be phased in over a three-year <br />period, based on the calculations of City staff, in order to recover the full costs associated with <br />permitting and inspection. <br /> <br />C. The Notice was also published in the Register-Guard, a newspaper of general <br />circulation within the City, on December 23, 24, 25, 26 and 27, 2001, and made available for <br />inspection by interested persons at the offices of the City Manager, 777 Pearl Street, Eugene, Oregon <br />97401, during normal business hours (8:00 a.m. to 5:00 p.m. Monday through Friday, exclusive of <br />holidays). The Notice provided that written comments would be received thereon for a period of30 <br />days from the date of publication. Notice was also posted at two locations at City Hall on January <br />14, 2002, and provided that written comments would be received for a period of 30 days from <br />December 23,2001. <br /> <br />D. No comments were received within the time or in the manner required by the Notice. <br />However, during the comment period, staff discovered a typographical error in the fee schedule <br />under Individual Permit Costs, and recommended that "Projects from 500 to 100 ft." should read <br />"Projects from 500 to 999 ft." I concur with the recommendation and the correction has been <br />incorporated into the fee schedule. <br /> <br />E.
