r <br />ORDINANCE NO. ~~~9 O <br />An Ordinance intiating the vacation of the following described <br />pedestrian right of way, to-wit: <br />A l0~foot wide pedestrian right of way contiguous <br />to Lots 12, 13, 21, and 22, Block S as platted and <br />recorded in Second Addition to Cambridge Park, in <br />book 53, page 9, Lane County Oregon Deed Records, <br />Reserving herein an easement for public utilities <br />above ground, on ground level, and underneath the <br />ground, and the right of access to construct, re~- <br />construct, and maintain the same over the above de~- <br />scribed property. ~Abarr, Hanarnura, Spear, Stredde <br />EV 7 9--17 <br />THE CITY OF EUGENE DOES ORDATN AS FOLLOWS: <br />Section 1, The City Council of the City of Eugene herein <br />initiates the .vacation proceedings on its own authority without <br />petition or consent of the property owners, except. as pravided by <br />statute, of the above described pedestrian right of way. <br />Section 2. A hearing shall be held upon the proposal to <br />vacate the pedestrian right of way as herein provided, and the <br />hearing shall be held on the 13th day of June, 1979 at 1200 o'clock <br />noon, Pacific Daylight Time of said date, at the Council Chambers, <br />City Hall, Eugene, Oregon, at which time all persons will be heard <br />upon objections or suggestions with regard to the vacation, and at <br />said time the Council will provide for the vacation of the pedestrian <br />right of way or deny such vacation, and in case the vacation is made, <br />will prova.de and make provision for any damages sustained by local <br />assessment. <br />Section 3. The City Recorder is hereby directed to immediately <br />publish once each week for four consecutive weeks in a newspaper pub <br />lished in Eugene, Lane County, Oregon, notice of the proposed vacation. <br />
