ORDINANCE NO.~~~' <br />AN ORDINANCE CONCERNING NOTICE OF HEARINGS OF <br />APPEALS To THE COUNCIL; AMENDING SECTION 2.007 <br />OF THE EUGENE CODE, 1971; AND DECLARING AN <br />EMERGENCY <br />THE CITY OF EUGENE DOES ORDAIN AS FoLLOwS: <br />Section 1. Section ~.007~9} of the Eugene Code, 1971, is hereby <br />amended to read and provide: <br />~9} The council shall establish a hearing panel which shall <br />consist of two councilors, each appointed for three months, to take <br />testimony in appeals to the council regarding: <br />~a} Street, sidewalk and sewer assessments. <br />fib} Decisions of the zoning board of appeals. <br />~c} Decisions of the department of parks and recreation <br />as to its rules. <br />Such an appeal shall be heard in public session. The panel shall see <br />that a record of the hearing of the appeal before the panel is kept <br />which shall include minutes of the testimony taken, and documents and <br />exhibits received during the hearing. For each such appeal the panel <br />shall prepare a written report of its findings and recommendations. <br />The report shall be submitted to all members of the council in the week <br />preceding the meeting at which the council takes final action on the <br />appeal. Appellants, those testifying at the initial hearing, and those <br />who, in writing, zequest notice of the appeal hearing shall be mailed <br />one week ~in~ advance notice of the time and place of the council hearing. <br />Further testimony regarding the appeal may be received by the council <br />only with the consent of two-thirds of the members of the council. <br />ordinance -- 1 <br />
