ORDINANCE NO. ~g~{~{~ <br />An Ordinance repealing Ordinance ~Io. 18429 and initiating the <br />vacation of the following described alley, to-wit: <br />The alley running through flock 3, Plat of Blair <br />Street Addition as recorded in Book 3 of Plats, <br />Page 9, Records of Lane County, Oregon. <br />RESERVING herein an easement for public utilities <br />above ground, on ground level and underneath the <br />ground, and the right of access to construct, re- <br />construct and maintain the same over the above des- <br />cribed alley. ~Ralls - AV 78-3~ <br />On the 16th day of May, 1979, the City Council of the City of <br />Eugene passed Ordinance No. 15395 <br />the 27th day of rune, 1979, at th{ <br />Eugene, Oregon, at which time and <br />could be heard as to the proposed <br />alley. <br />The hearing was head at that <br />setting a hearing to be held on <br />s Council Chambers at City Hall, <br />place protests and remonstrances <br />vacation of the above described <br />time and place, and Ordinance No. <br />18429 vacating the above described alley was passed by the City <br />Council. However, notice was not duly and regularly given of the <br />hearing, and ordinance No. 18429 should be repealed and a new hear- <br />ing called thereon, and now, therefore, <br />THE CITY OF EUGENE DOES ORDAIN AS FOLI,OwS: <br />Section 1. Ordinance zoo. 18429 passed by the City Council and <br />approved by the Mayor on June 2'~, 1979 is hereby repealed. <br />Section 2. The City Council of the City of Eugene herein inm- <br />ates the vacation proceedings on its own authority without petition <br />or consent of the property owners, except as provided by statute, of <br />the above described alley. <br />Ordinance - 1 <br />
