ORDINANCE NO.. <br />AN ORDINANCE CONCERNING THE MECHANICAL SPECIALTY <br />CQDE; AMENDING SECTIONS 8.495 AND 8.540 OF THE <br />EUGENE CODE, 1971; AND DECLARING AN EMERGENCY. <br />THE CITY OF EUGENE DOES ORDAIN AS FQLLOWS: <br />Section 1. Section 5.495 of the Eugene Code, 1971, is hereby <br />amended to provide: <br />8.495 Mechanical_ Speci.alt~_Cade. The fo~,lowing codes are <br />hereby adopted as the Mechanical Specialty Code of the <br />city <br />~.a7 The State of Oregon Mechanical Specialty Cade, <br />excepting Chapters 1, ~ and 3 thereof, as adopted by the <br />Director of the Oregon Department of Commerce pursuant <br />to ORS 456.750 to 456.885. <br />fib} Chapters. 1, ~ and 3, and chapter 22 of Appen- <br />dix B, of the 1976 Edition of the Uniform Mechanical <br />Code, published and copyrighted in 1976 by the Inter- <br />national Conference of Building Officials, as amended <br />by section 8.500 of the Eugene Code, 1971. <br />Copies of each code shall be filed in triplicate in the office <br />of the finance officer. <br />Section 2. Section 8.500 of the Eugene Code, 1971, is hereby <br />amended to provide: <br />8.500 Mechanical S ecialt Code ~- Amendments. Chapters 1, 2 <br />and 3 ~-of the, 1976 Edition of the Uniform Mechanical Code <br />are hereby amended as follows: <br />Via} Section 202, second paragraph is deleted. <br />~.b} Section 203 is amended to read: <br />Section 203. The owner of a <br />.~ . <br />building or structure, o~r~~any other person, may <br />appeal to the board of appeals from a decision of <br />the building of f ic,ial refusing to~ grant a madif i- <br />cation of the provisions of the mechanical code <br />covering the suitability of alternate materials, <br />types of construction and installation, or to pro- <br />vide for reasonable interpretations of the provi- <br />sions of this Cade. An application far appeal <br />may be made when it is claimed that the true in- <br />tent of the mechanical specialty code has been <br />incorrectly interpreted, the provisions of the <br />mechanical, specialty code do not fully apply, or <br />an equally good or better material, method of con- <br />struction or installation is proposed. <br />Ordinance - 1 <br />
