ORDINANCE NO. 8~1 ~O <br />AN ORDINANCE CONCERNING ~IEHICLES IN THE MALL; <br />AMENDING SECTIONS 5.565, 5.570, 5.575 AND 5.5$0 <br />OF THE EUGENE CODE, 1971; AND DECLARING AN <br />EMERGENCY. <br />THE CITY CF EUGENE DOE5 ORDAIN AS FOLLOWS: <br />Section 1. Subsection t:4~ of Section 5.565 of the Eugene Code, <br />1971, is hereby amended to provide: <br />5.565 Vehicles in Mall - Prohibited. <br />~4~ Except for vehicles of the fire department, police <br />department, and maintenance operations of the city, no person <br />shall operate a motor vehicle within the Eugene Pedestrian Mall <br />without having obtained a permit from the parks and recreation <br />director as provided in this chapter. <br />Section 2. Section 5.5?0 of the Eugene Code, 1971, is hereby <br />amended to providep <br />5.570 ~Tehicles in Mall -~ Permit, Fee, Damage Deposit, <br />~1~ Any person desiring to operate a motor vehicle <br />within the mall must file with~the parks and recreation direc- <br />tor a written application for a permit. He shall state the <br />destination point, date and time, type and weight of vehicle, <br />and purpose for which the motor vehicle access is needed. <br />~Z~ It shall be the duty of the parks and recreation <br />direci:ar or his representative to examine the application and <br />to determine the proper access route, the time when the route <br />can be used, and any special precautions which may be neces- <br />sary to safeguard the public or the mall structures and. sur- <br />faces. If the permit is granted, it shall specify the require- <br />ments as determined by the parks and recreation director, and <br />shall also designate the mall surfaces which are designated <br />for pedestrian use only, and on which vehicles shall not travel. <br />The applicant shall pay a fee of $5.00 to caner the cost of <br />issuing the per.~it and inspecting the access area,. The appli- <br />cant shall also deposit an amount equal to the parks and re- <br />creation director's estimate of the cost to restore any of the <br />mall facilities which will be disturbed as a result of the <br />applicant's operations. <br />Section 3, Subsection ~Z~ of Section 5.575 of the Eugene Code <br />1971, is hereby amended to provide <br />ordinance - 1 <br />
