N4. ~~74~ <br />Ax3 ORD~N`ANCE AD~PT~NG 1H,E ~~~~H 4F C~~EGQN ~ECH~N`TOAI~ <br />SPECIALTY C~JDE AND NIECH~N2.C,~ `~'~RE ANA LI:~'E SAFETY <br />CQDE; AMENDING SECTION 8.495 QF THE EUGENE CODE, 1971; <br />AND DECLARTNO AN E'MERGEN`CY`. <br />The City Council of the City of Eugene ,finds that: <br />The State of Oregon has adopted as its Mechanical Specialty <br />Code and Mechanical Fire and Life Safety Code, with certain state <br />amendments, the Uniform Mechanical Code, 1979 Edition, promulgated <br />by the International Conference of Building Officials. <br />The State of Oregon Mechanical Specialty Code and Mechanical <br />Fire and Life Safety Code may be administered at the local government <br />level, <br />ORS 456.775 and 456.800 permit municipal administration of the <br />state's construction specialty codes. <br />NOW, ~H.~REFORE , <br />THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: <br />Section 1. Section 5.495 of the Eugene Code, 1971, i.s hereby <br />amended to read: <br />5.495 Mechanical Specialty Gode. All installation, construc- <br />tion, alteration, repair, replacement, and use of mech- <br />anical systems, including, but not limited to, heating, ventila- <br />tion and air conditioning equipment and systems, commenced after <br />July 1, 1950, shall comply with the State of Oregon Mechanical <br />Specialty Code and Mechanical Fire and Life Safety Code, except <br />Chapters 1, 2, and 3 thereof. The State of Oregon Mechanical <br />Specialty Code and Mechanical Fire and Life Safety Code is <br />hereby adopted by the city and shall const~.tute the mechanical <br />specialty code of the city. Copies of the code shall be filed <br />in triplicate in the office of the city finance officer. <br />Section _2. If any section, subsection, clause, or phrase of <br />this Ordinance is, for any reason, held to be unconstitutional, such <br />decision shall not affect the validity of the remaining portions of <br />this Ordinance. 'the City declares that i:t would have passed this <br />Ordinance, including the referenced Mechanical Specialty Code, one <br />section, clause, or phrase at a time, irrespective of the fact that <br />Ordinance - 1 <br />
