The public parking garage is <br />proposed for development by Broadway & High Associates, LLC and Gerding/Edlen <br />Development Company (B & H and GED, respectively). The garage would be located on the <br />northern side of the block bounded by 8th, Broadway, Mill and High, adjacent to the proposed <br />Whole Foods Market. <br /> <br />The authority to grant exemption from the competitive selection process is found in Eugene <br />Code 2.1425 (1), which states as follows: "In its capacity as contract review board for the city, <br />the city council, upon its own initiative, or upon request of the purchasing agent, may create <br />special selection, evaluation and award procedures for, or may exempt from competition, the <br />award of a specific contract or class of contracts as provided in this section 2.1425." <br /> <br />A draft resolution and findings supporting the proposed exemption is included as Attachment A. <br />This public hearing is held pursuant to Eugene Code 2.1425 (3). The language of this section of <br />the code is included as Attachment B. <br /> <br /> <br />BACKGROUND <br />The council considered the East Broadway Development Projects on February 8 and on February <br />13 and directed the City Manager to begin negotiations on the land transaction, the development <br />agreement, and related legal documents, for public garage development Option 4. This option <br />th <br />includes approximately 260 parking spaces and a commercial space at the corner of 8 Avenue <br />and High Street. On February 22, the council deferred action on the project until after a public <br />hearing on an exemption from competitive selection requirements. <br /> <br />Background information on this project was included in the City Council Agenda Item Summary <br />for February 8, 2006. <br /> <br />Financial and/or Resource Considerations <br />The City’s participation in the East Broadway Development Projects involves significant <br />financial and resource considerations.
