ORDINANCE NO. 20438 <br />AN ORDINANCE AMENDING THE EUGENE - SPRINGFIELD <br />METROPOLITAN AREA GENERAL PLAN TEXT, CHAPTER III, <br />SECTION D, POLICY # 11; ADOPTING AN EXCEPTION TO <br />STATEWIDE PLANNING GOAL 15 WILLAMETTE RIVER <br />GREENWAY; ADOPTING A SEVERABILITY CLAUSE; AND <br />PROVIDING AN EFFECTIVE DATE. <br />THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: <br />A. Policy #11 of Chapter III, Section D of the Eugene - Springfield Metropolitan Area <br />General Plan (Metro Plan) requires the taking of an exception to Statewide Goal 15 if a non- <br />water- dependent transportation facility requires placing fill within the Willamette Greenway. <br />B. On June 26, 2009, Springfield initiated a Metro Plan amendment containing <br />language establishing an exception to Statewide Planning Goal 15 (Willamette Greenway) for <br />the purpose of constructing a bicycle viaduct underneath the 1 -5 bridges on the South Bank of the <br />Willamette River. <br />C. Chapter IV of the Eugene - Springfield Metropolitan Area General Plan (Metro <br />Plan) sets forth procedures for amendment of the Metro Plan, which for Eugene are implemented <br />by EC 9.7700 through 9.7750. <br />D. Following a September 1, 2009 joint public hearing with the Springfield and Lane <br />County Planning Commissions, the Eugene Planning Commission, on September 1, 2009 <br />recommended Metro Plan amendments taking an exception to Statewide Planning Goal 15 <br />Willamette River Greenway, to the Eugene City Council. <br />E. The City Council conducted a joint public hearing on this amendment on <br />September 22, 2009, with the Springfield City Council and the Lane County Board of <br />Commissioners, and is now ready to take action based on the above recommendations and <br />evidence and testimony already in the record as well as the evidence and testimony presented at <br />the joint elected officials public hearing. <br />F. Substantial evidence exists within the record demonstrating that the proposal <br />meets the requirements of the Metro Plan, Eugene Code and applicable state and local law as <br />described in the findings attached as Exhibit A, and which are adopted in support of this <br />Ordinance. <br />Ordinance - Page 1 of 2 <br />
