<br />ORDINANCE NO. 20363 <br /> <br />AN ORDINANCE PROVIDING FOR WITHDRAWAL OF TERRITORIES <br />FROM THE RIVER ROAD WATER DISTRICT AND THE RIVER ROAD <br />PARK AND RECREATION DISTRICT, AND FROM THE SANTA <br />CLARA WATER DISTRICT. (CB #4921) <br /> <br />The City Council of the City of Eugene finds that: <br /> <br />A. Resolution No. 4857 adopted on January 23, 2006, proposed withdrawal from the <br />River Road Water District, the River Road Parks and Recreation District, and the Santa Clara <br />Water District ("the Districts"), the parts of the Districts annexed to the City as described therein. <br /> <br />B. The Resolution set February 27, 2006, at 7:30 p.m., in the Council Chambers, <br />City Hall, in Eugene, Oregon, as the time and place for hearing objections to the withdrawals, <br />and directed that notice of the time and place of the hearing be published once each week for two <br />successive weeks prior to the hearing and that the notice be posted in four public places in the <br />City for the same period. The Notice has been so published in the Register Guard and posted in <br />four public places in the City of Eugene, Oregon. However, in order to comply with the <br />Ordinance notice requirements of the Eugene Charter 2002, it was necessary to reschedule the <br />public hearing to March 13, 2006. A Notice advising of the March 13, 2006 hearing date was <br />published in the Register Guard once each week for two successive weeks prior to the hearing, <br />and posted in four public places in the City for two successive weeks prior to the hearing. In <br />addition, City staff attended the February 27, 2006 Council meeting and advised those in <br />attendance of the rescheduled hearing date. <br /> <br />c. The City is willing to assume the liabilities and indebtedness previously <br />contracted by the Districts proportionate to the parts of the Districts that have been annexed to <br />the City upon the effective date of the withdrawals. <br /> <br />D. The withdrawals of the annexed territories from the Districts are consistent with <br />the fundamental principles and applicable policies of the Eugene-Springfield Metropolitan Area <br />General Plan, and other adopted City policies, and it is in the best interest of the City that the <br />territories be withdrawn. <br /> <br />NOW, THEREFORE, <br /> <br />THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: <br /> <br />Section 1.
