due the City (except for deferred assessments). Section 2.023 of the Eugene Code, 1971, <br />authorizes the City Manager to charge less than the established 18% interest rate, upon making <br />certain findings. In support of my reduction of the 18% interest rate to zero interest, I find as <br />follows: <br />1. The interest revenue collected exceeds the full cost of managing the <br />amounts due the city including the city's costs of retiring any debt incurred <br />by the city; <br />2. There will be no significant loss of city general revenues as a result of the <br />reduction; and <br />All similarly situated obligors of the city will receive a comparable benefit <br />from the reduction. <br />F. The proposed amendments, along with the current fee, were set out in the Notice <br />attached as Exhibit A to Administrative Order No. 58- 12 -07. The Notice stated that written <br />comments would be received for a period of 15 days from the date of posting and publication. <br />The Notice was provided to the Mayor and City Councilors, and made available for inspection <br />by interested persons at City Hall, 777 Pearl Street, Room 105, Eugene, Oregon, during normal <br />business hours. A copy of the Notice was also posted at two locations at City Hall and published <br />in the Register -Guard newspaper on May 14, 2012. No written comments were received within <br />the time or in the manner provided in the Notice. <br />G. I find that the proposed fees set forth in Exhibit A have been computed in a <br />manner consistent with the requirements of the City's agreement with ODSL and USACOE, and <br />are necessary in order to provide a sustainable budget for the wetland mitigation program. In <br />determining the proposed fee, I have considered the applicable policies, enactments and <br />directives of the City Council, the amount charged for these services by the City in the past, the <br />full costs of providing the services supported by the fee, the amounts charged by other <br />comparable providers, and the revenue needs of the City as determined by the adopted City <br />budget. <br />On the basis of these findings, I order that: <br />1. The Wetlands Mitigation Bank fee to be charged as of the effective date of this <br />Order is attached as Exhibit A to this Order. <br />2. Administrative Order No. 58- 10 -09 -F is repealed as of the effective date of this <br />Order. <br />Dated and effective this 6th day of June , 2012. <br />Jon R.
