ADMINISTRATIVE ORDER NO. 58-14-04 <br />of the <br />Executive Director of the Public Works Department <br />EXTENDING THE TEMPORARY CLOSURE OF A PORTION OF <br />SCOBERT PARK ESTABLISHED BY ADMINISTRATIVE ORDER NO. <br />58- 12 -05. <br />The Executive Director of the Public Works Department finds that: <br />A. Pursuant to the authority of Administrative Order No. 21 -03 -12 issued by the City <br />Manager, the Executive Director of the Public Works Department is authorized to regulate City <br />parks, protect park visitors and the park environment, and adopt rules regarding the use of parks. <br />B. Section 1.003 of the Parks and Open Space Rules, adopted by Administrative <br />Order No. 58- 13 -01 -F, authorizes the temporary closure of all or any portion of a park, open <br />space, or facility upon finding that conditions that threaten the welfare or safety of nearby <br />residents exist and the need to preserve their welfare and safety outweighs the public's right of <br />access to the park, open space and /or facility. <br />C. On April 16, 2010, I issued Administrative Order No. 58 -10 -04 closing a portion <br />of Scobert Park, located at 1180 West 4 th Avenue, effective 12:01 a.m. on April 23, 2010 until <br />April 22, 2012. On March 19, 2012, I issued Administrative Order No. 58 -12 -05 extending the <br />temporary closure until April 22, 2014. <br />D. It is necessary to extend the closure because the above - mentioned portion of <br />Scobert Park continues to be a haven for illegal activities creating an atmosphere that threatens <br />the welfare and safety of the residents in the area. Efforts to curtail the illegal activities, <br />including the fencing of the area, have been unsuccessful. <br />E. The need to protect and preserve the welfare and safety of residents living nearby <br />Scobert Park outweigh the public's right of access to the fenced portion of Scobert Park. <br />Now, therefore, based on the above findings, which are hereby adopted: <br />IT IS HEREBY ORDERED THAT: <br />1. The closure of the portion of Scobert Park, located at 1180 West 4 th Avenue, <br />delineated by a black wrought iron fence erected by the City, is extended and shall be closed to <br />entry by all persons other than police officers, authorized City employees and persons with <br />written authorization from the Public Works Director or the Parks Maintenance Manager until <br />April 22, 2016. <br />Administrative Order - Page 1 of 2 <br />
