ADMINISTRATIVE ORDER NO. 58-15-01 <br />of the City Manager <br />APPOINTING MARK SCHOENING AS HEARINGS OFFICER FOR <br />APPEAL OF CIVIL PENALTIES ISSUED PURSUANT TO SECTION <br />6.446 OF THE EUGENE CODE, 1971. <br />The City Manager of the City of Eugene finds that: <br />A. Under the provisions of Chapter IV, Section 16 of the Eugene Charter of 2002, <br />the City Manager is designated as the administrative head of the City, specifically authorized to <br />appoint and remove all employees (except as otherwise provided in the Charter), organize, and, <br />as deemed necessary, disband and reorganize various City departments, and to enforce all <br />ordinances of the City. <br />B. Section 6.446 of the Eugene Code, 1971 (EC), sets out the City's regulations <br />concerning discharge of foreign matter. <br />C. The City Manager or the Manager's designee may issue a notice of violation for <br />any violation of EC 6.446, and a person who is issued a notice of civil penalty may appeal the <br />penalty to a Hearings Officer using the process prescribed in EC 2.021. <br />D. It would be most efficient and in the public interest to appoint Mark Schoening to <br />act as Hearings Officer to hear and make determinations on appeals of civil penalties issued <br />pursuant to EC 6.446. <br />On the basis of these findings, I order that Mark Schoening is appointed as the <br />Hearings Officer to hear and make determinations on appeals of civil penalties issued pursuant to <br />Section 6.446 of the Eugene Code, 1971. <br />Dated and effective this �`Ft-� of January, 2015. <br />Jon R.
