ADMINISTRATIVE ORDER NO. 56-04-03-F <br /> of the <br /> City Manager of the City of Eugene <br /> <br /> AMENDMENT OF FEES FOR PRIVATE COMMERCE ON <br /> PUBLIC PROPERTY AND REPEALING ADMINISTRATIVE <br /> ORDER NO. 53-02-01-F. <br /> <br /> The City Manager of the City of Eugene finds as follows: <br /> <br /> A. Section 2.020 of the Eugene, Code, 1971 authorizes the City Manager to determine <br />and set fees and charges to be imposed by the City for services, goods, use of municipal property, <br />and licenses and permits. <br /> <br /> B. In accordance with the procedures set forth therein, on December 6, 2004, I issued <br />Administrative Order No. 56-04-03 and notified the Mayor and City Councilors that I intended to <br />amend the fee schedule for Private Commerce on Public Property as set forth in the Notice of <br />Intended Amendment of Fees attached as Exhibit A thereto. <br /> <br /> C. Copies of the Notice were also posted at two locations at City Hall on December 13, <br />2004, and made available for inspection by interested persons at the offices of the Eugene Police <br />Department, 777 Pearl Street, Room 107, Eugene, Oregon, 97401, during regular business hours (8 <br />a.m. to 5 p.m., Monday through Friday, exclusive of holidays). <br /> <br /> D. The Notice provided that written comments would be received for a period of 15 <br />days from the date of posting. No written comments were received within the time or in the manner <br />required by the Notice. <br /> <br /> E. In determining the proposed fee amendments, I have considered the applicable <br />policies, enactments and directives of the City Council, the amount charged for these services by the <br />City in the past, the full costs of providing these services supported by the fees, the amounts charged <br />by other comparable providers, and the revenue needs of the City as determined by the adopted City <br />budget. I further find that the fees and text revisions should be amended as proposed in order to <br />conform to recently adopted provisions of the Eugene Code, 1971, and the unamended Private <br />Commerce on Public Property fees should be incorporated into the new fee schedule and <br />Administrative Order No.53-02-01-F should be repealed. <br /> <br /> On the basis of these findings, I order that: <br /> <br /> 1. The fees set forth in Exhibit A hereto are the fees to be charged for the services <br /> therein as of the effective date of this Order. <br /> <br /> 2. The unamended fees are incorporated into the new fee schedule and Administrative <br /> Order No.53-02-01-F is repealed as of the effective date of this Order. <br /> <br /> Administrative Order - 1 <br /> <br /> <br />
