<br />ADMINISTRATIVE ORDER NO. 58-00-16-F <br />of the <br />City Manager of the City of Eugene <br /> <br />ADOPTING FEES FOR OPEN <br />WATERWAY EXEMPTION PERMITS <br /> <br />The City Manager of the City of Eugene finds as follows: <br /> <br />A. Section 2.020 of the Eugene Code, 1971 authorizes the City Manager to determine <br />and set fees and charges to be imposed by the City for services, goods, use of municipal property, and <br />licenses and permits. <br /> <br />B. In accordance with the procedures set forth therein, on June 13, 2000 I issued <br />Administrative Order No. 58-00-16 proposing to establish the Open Waterway Fee Schedule as set <br />forth in the Notice attached as Exhibit A thereto and incorporated therein by reference. <br /> <br />C. The Notice was provided to the Mayor and City Councilors, posted at two locations <br />at City Hall, provided to any persons who have requested such notice, and was made available for <br />inspection by interested persons at the offices of the City's Public Works Department, Administrative <br />Division, 858 Pearl Street, Eugene, Oregon 97401 during normal business hours (9:00 a.m. to 5:00 <br />p.m., Monday through Friday, exclusive of holidays). The Notice provided that written comments <br />would be received thereon for a period of fifteen days from the date of posting. No comments were <br />received within the time and manner required by the Notice. However, during the comment period <br />staff members who had investigated the potential costs to be incurred in connection with appeals, <br />including hearings official charges of approximately $75 per hour, recommended that the appeal fee <br />be increased to $200.00. I concur with that recommendation, and the revised fee is included in the <br />attached fee schedule. <br /> <br />D. I find that the proposed fees, which were developed on the basis of estimations of the <br />costs associated with processing applications for exemptions under newly adopted provisions of the <br />Eugene Code, 1971, including salary, benefits, materials, supplies and indirect costs for employees <br />performing the services, are necessary in order to comply with the Council's goal of recovering the <br />cost of providing such services from the beneficiaries thereof <br /> <br />On the basis of these findings, I order that: <br /> <br />The fees set forth in the Open Waterway Fee Schedule attached as Exhibit A hereto are <br />hereby adopted as the fees to be charged for the services set forth therein, effective July 14, 2000. <br /> <br />Dated this ~ day of July, 2000. <br /> <br />~ <br /> <br />~e-cJL <br /> <br />James R.
