ADMINISTRATIVE ORDER NO. 52-16-04 <br />of the <br />City Manager of the City of Eugene <br />EXTENSION OF TEMPORARY AMENDMENT OF EUGENE FIRE CODE <br />ADMINISTRATIVE RULE R-8.010FC ADOPTED BY ADMINISTRATIVE <br />ORDER NO. 52-16-01. <br />The City Manager of the City of Eugene finds that: <br />A. Section 8.010 of the Eugene Code, 1971, authorizes the City Manager to <br />administratively adopt a fire code for the City of Eugene. Pursuant to that authority, and in <br />accordance with the procedures set forth in Section 2.019 of the Eugene Code, 1971, on December <br />22, 2014, Administrative Order No. 52-14-02-F was issued adopting Eugene Fire Code <br />Administrative Rule R-8.01 OFC. That Rule amended the Oregon 2014 Fire Code Amendments to <br />the 2012 International Fire Code. <br />B. On March 16, 2015, Administrative Order No. 52-15-02 was issued adopting <br />temporary amendments to the Fire Code Rule until September 12, 2015. The amendments were <br />made in order to exempt from the permitting and code requirements all tents 400 square feet or <br />smaller, regardless of the number of small tents used for an event. <br />C. On August 26, 2015, Administrative Order No. 52-15-06 was issued effective <br />September 12, 2015, reaffirming and extending the temporary Fire Code Rule amendment until <br />March 10, 2016. <br />D. In March of 2016, Administrative Order No. 52-16-01 was issued revising the <br />temporary Fire Code Rule amendments to provide that tents 400 square feet or smaller, regardless <br />of the number of small tents, are exempt from Section 3103 (not exempt from entire Chapter 31 <br />as provided by Administrative Order No. 52-15-06). That Order became effective on March 10, <br />2016, and will expire on September 6, 2016. <br />E. The temporary Fire Code Rule amendments established by Administrative Order <br />No. 52-16-01 should be extended because more time is needed to address issues concerning these <br />Rule amendments. Temporary Rules are authorized by EC 2.019(5). - <br />NOW THEREFORE, the temporary Fire Code Rule amendments made to sections <br />105.6.43 and 3103.2 of Eugene Fire Code Administrative Rule R-8.010FC by Administrative <br />Order No. 52-16-01 are extended and reaffirmed as set out below. <br />This temporary Rule shall become effective on September 6, 2016, and shall remain in <br />effect until March 4, 2017 (180 days from the effective date of this Order) unless replaced earlier <br />by an emergency rule, temporary rule, or permanent rule adopted in accordance with the provisions <br />of EC 2.019. <br />Administrative Order - Page 1 of 2 <br />
