ADMINISTRATIVE ORDER NO. 53-18-04 <br />of the <br />City Manager <br />AMENDING THE TERMS OF USE FOR THE DUSK TO DAWN SITE AT <br />605 AND 717 HIGHWAY 99 AND REPEALING ADMINISTRATIVE ORDER <br />NO. 53-17-06. <br />The City Manager of the City of Eugene finds that: <br />A. Under the provisions of Chapter IV, Section 16 of the Eugene Charter of 2002, the <br />City Manager is designated as the administrative head of the City, specifically authorized to <br />enforce all ordinances of the City. <br />B. On November 23, 2015, Ordinance No. 20559 was adopted approving the Dusk to <br />Dawn overnight sleeping pilot program. That Ordinance provided. that sleeping overnight at <br />designated sites would be pennitted upon Council's approval of a site and the City Manager's <br />adoption of an administrative rule governing use of the site. Ordinance No. 20559 was amended <br />on March 14, 2016, by Ordinance No. 20563, to allow the City Manager to consider the seasonal <br />sunset in determining the hours of permitted overnight sleeping at designated sites. <br />C. On March 1, 2017, Ordinance No. 20576 was adopted removing the sunset date <br />from the Dusk to Dawn Program. On March 29, 2017, the City Manager issued Administrative <br />Order No. 53-17-03-F, adopting permanent rules and regulations for the Dusk to Dawn Overnight <br />Sleeping Program. On January 22, 2018, the City Manager issued Administrative Order No. 53- <br />17-03-F adopting a temporary amendment to that rule which gives the City Manager the option of <br />authorizing families with children to use certain approved Dusk to Dawn sites. <br />D. On October 23, 2017, the City Council approved a site at 605 and 717 Highway 99 <br />as a site for the Dusk to Dawn overnight sleeping program, to replace a former site at the Eugene <br />Service Station and allow for expanded capacity. On October 31, 2017, the City Manager issued <br />Administrative Order No. 53-17-06 which authorized up to 80 persons to sleep overnight at that <br />site. <br />E. It is necessary to amend the terms of the use for the Highway 99 site to allow more <br />people to use the site. <br />NOW THEREFORE, based on the above findings, I order that: <br />1. The terms of use for the 605 and 717 Highway 99 Dusk to Dawn overnight sleeping <br />site are amended to provide as follows: <br />Up to 95 persons may sleep overnight at 605 and 717 Highway 99 pursuant to the <br />Dusk to Dawn overnight sleeping program (a) adopted by Ordinance No. 20559, and <br />Administrative Order - Page 1 of 2 <br />
