ADMINISTRATIVE ORDER NO. 58-18-10 <br />of the <br />City Manager <br />EXTENSION OF EMERGENCY RULE AMENDING THE AIRPORT <br />RULES. <br />The City Manager of the City of Eugene finds that: <br />A. Pursuant to the authority contained in Sections 2.019 and 2.430 of the Eugene <br />Code, 1971 (EC), the current Rules Governing the Use of Mahlon Sweet Airport ("Airport <br />Rules") were adopted by Administrative Order No. 58-07-01-F on February 12, 2007. <br />B. On July 16, 2015, Administrative Order No. 58-15-25 was issued establishing an <br />emergency Rule amending the Airport Rules to add a provision prohibiting persons from <br />possessing marijuana in any restricted area of the Airport unless the person's flight destination is <br />within the state of Oregon or the marijuana is medical. This Rule is necessary in order to comply <br />with state and federal law related to transporting marijuana outside of the state of Oregon. <br />C. The emergency Rule established by Administrative Order No. 58-15-25 was set to <br />expire on January 12, 2016, but has been extended, most recently by Administrative Order No. <br />58-17-27, which will expire on May 29, 2018. The emergency Rule should be extended because <br />more time is needed to finalize comprehensive amendments to the Airport Rules, and it would be <br />most efficient to adopt the emergency Rule as a permanent Rule at the same time as the <br />comprehensive amendments to the Airport Rules are processed. Adoption of this emergency <br />Rule is authorized by subsection (6) of Section 2.019 of the Eugene Code, 1971. <br />NOW, THEREFORE, based upon the above findings, and pursuant to the authority in <br />Sections 2.019(6) and 2.430 of the Eugene Code, 1971, 1 order that the emergency amendment to <br />the Airport Rules adopted by Administrative Order No. 58-15-25 is extended effective May 29, <br />2018, and shall remain in effect until November 25, 2018 (180 days from May 29, 2018) unless <br />replaced earlier by an emergency rule, temporary rule, or permanent rule adopted in accordance <br />with the provisions of EC 2.019. <br />Dated this _SL-rday of May, 2018. <br />Jon RRnager <br />City .M <br />Administrative Order -Page 1 of 1 <br />
