ADMINISTRATIVE ORDER NO. 44-05-05 <br /> <br /> of the <br /> City Manager <br /> City of Eugene, Oregon <br /> <br />PARTIAL DELEGATION OF AUTHORITY FOR ADMINISTRATION OF <br />THE CITY OF EUGENE'S PUBLIC CONTRACT ADMINISTRATt~VE <br />RULE R-1415. <br /> <br />The City Mauager of the City of Eugene finds that: <br /> <br /> A. Under the provisions of Chapter tV, Section 16 of the Eugene Charter of 2002 <br />(~Charter"), the City Manager is designated as the administrative head of the City, and is <br />specifically authorized to appoint and remove all employees (except as otherwise provided in the <br />Charter), and to enfbrce all ordinances of the City. Section 16(2) of the Charter authorizes the <br />City Manager to make purchases and act as the business agent fbr the City Council in connection <br />with the sale of real estate and other business and commercial transactions. Pursuant to this <br />Charter authority the City Manager issued Administrative Order No. 44-04-10 delegating <br />contract signing authority as set forth therein. <br /> <br /> In addition to the above Charter authority, Section 2.019 of the Eugene Code, <br />1971 CCode") authorizes the City Manager to adopt rules ~'or administration and implementation <br />of any provisions of the Code. New public contract provisions were added to the Code by <br />Ordinance No. 20341, effective March 1, 2005, and in Section 2.14115 the City Manager, as the <br />City's Purchasing Agent, is specifically authorized to adopt rules fbr implementation of those <br />provisions. Temporary Pt~blic Contract Administrative Rule R-1415 was adopted and effective <br />on March 7 2005~ <br /> <br /> I find that it would be more efficient in administering the City's Public Contract <br />Regulations to delegate some of the duties, responsibilities and authority of the Purchasing Agent <br />and Solicitation Agent under those Regulations as set forth in this Order. <br /> <br />Based on the above, the City Manager of the City of Eugene orders that: <br /> <br /> 1. Purchasing &gent. The duties, responsibilities and authority of the Purchasing <br />Agent in the following provisions of R-1415 are hereby delegated to the Manager of the <br />Purchasing Section of the Department of Central Services: <br /> <br /> a. Subsection 1.3.7. Determination that a contract concerning predominantly <br />financial transactions of the City cannot practically be established under competitive <br />contractor selection procedures. <br /> <br /> b. Section 1.5. Authority to use the rules adopted by the Oregon Attorney <br />General pursuant to ORS 279A.065 as supplemental rules, if needed to address <br />circumstances not provided for by the Regulations. <br /> <br />Administraive Order ~ 1 <br /> <br /> <br />
