<br /> <br />ECC <br />UGENE ITY OUNCIL <br />AIS <br />GENDA TEM UMMARY <br /> <br /> <br /> <br /> <br />Work Session: Mid-Point Evaluation for Judge Allen <br /> <br /> <br />Meeting Date: September 24, 2008 Agenda Item Number: B <br />Department: Central Services Staff Contact: Kristie Hammitt <br />www.eugene-or.gov Contact Telephone Number: 682-5019 <br /> <br /> <br /> <br /> <br />ISSUE STATEMENT <br /> <br />This work session provides an opportunity for the council to hold a discussion with Presiding Municipal <br />Judge Wayne Allen on the findings of the 2008 mid-point judicial evaluation, and other topics relevant <br />to judicial performance. <br /> <br /> <br />BACKGROUND <br /> <br />Presiding Judge Wayne Allen was appointed by the council in 1994. Judge Allen’s last formal <br />evaluation was conducted in 2006 and he was reappointed to another four-year term. He is currently in <br />the second year of his four-year contract period. <br /> <br /> <br />RELATED CITY POLICIES <br />Municipal Court has concurrent jurisdiction with Lane County Circuit Court for violations and <br />misdemeanor crimes in Oregon statute and in Eugene City Code, including all traffic offenses. <br />Municipal Court has sole jurisdiction over all parking offenses which violate City Code. Municipal <br />judges have authority to adjudicate cases, impose fines and other sanctions, issue warrants, summon <br />jurors and perform all other judicial functions, according to Oregon statute governing justice court, <br />Eugene Charter and Eugene City Code. The judges are part-time independent contractors, not <br />employees of the City. The Presiding Judge is appointed by the City Council. <br /> <br />Eugene Code Sections 2.011 (2) outlines the four-year evaluation process. The two-year (mid-point) <br />is an informal evaluation that includes a completed self-appraisal and collection of evaluation input <br />from members of the Eugene Police Department, City Prosecutor’s Office, defense counsel, and court <br />staff. The survey information was completed in June 2008. Evaluation input collected indicates those <br />surveyed strongly agree or agree that Judge Allen continues to meet the performance standards in the <br />six categories assessed.
