ADMINISTRATIVE ORDER NO. 53-19-01-F <br />of the <br />City Manager of the City of Eugene <br />AMENDMENT OF THE PARKING FEE SCHEDULE AND REPEAL OF <br />ADMINISTRATIVE ORDER NO. 53-15-08-F. <br />The City Manager of the City of Eugene finds as follows: <br />A. Section 2.020 of the Eugene Code, 1971 (EC), authorizes the City Manager to <br />determine and set fees and charges to be imposed by the City for services, goods , use of <br />municipal property, and licenses and permits. In addition, EC 5.040 authorizes the City Manager <br />to impose conditions upon which City streets and other public property may be used for parking. <br />EC 5.285(5) provides that charges for off-street parking facilities must be established by <br />administrative action of the City Manager. EC 5.335(2) authorizes the City Manager to <br />designate on-street parking meter zones, hourly rates and time limitations by administrative <br />action, subject to the maximum charges for on-street parking meter rates in subsection EC <br />5.335(1). <br />B. Pursuant to the authority referenced above, the most recent amendments to the <br />Parking Fee Schedule ("the Fee Schedule") were adopted on August 27, 2015 , by Administrative <br />Order No. 53-15-08-F. After reviewing those fees, it was determined that parking fee <br />amendments were necessary so that the fees charged more accurately recovered the City's costs <br />of operating and managing the City's parking resources. <br />C. On December 28,2018, I issued Administrative Order No. 53-19-01 , ordering that <br />notice be given of the opportunity to submit written comments on a propos al to amend the Fee <br />Schedule. The proposed amendments were set out in the Notice attached a s Exhibit A to that <br />Administrative Order. <br />D. Notice of the proposed amendments to the Fee Schedule was given to the Mayor <br />and City Councilors and to persons who had requested notice of such fees; was posted at two <br />locations at City Hall; and was made available for review at Parking Se rvices, Planning & <br />Development Department; 99 West 1 Oth Avenue , Eugene, Oregon. The notice provided <br />interested persons an opportunity to submit comments on the proposed amendments until the end <br />of the day on January 18,2019. <br />E. Based on my investigation of the revenue needs of the City in providing parking <br />services pursuant to EC 2.020(2), 5.050, and 5.285(7), and after considering the comments <br />submitted, I have modified some of the proposed parking fee amendments, and I find that the <br />parking fees should be set as provided in Exhibit B attached to this Order.
