<br />ADMINISTRATIVE ORDER NO. 52-07-03-F <br />of the <br />City Manager of the City of Eugene <br /> <br />AMENDMENT OF FEES FOR FIRE SAFETY AND HAZARDOUS <br />MATERIALS PERMITS AND REPEAL OF ADMINISTRATIVE ORDER <br />NO. 52-04-03-F. <br /> <br />The City Manager of the City of Eugene finds as follows: <br /> <br />A. Section 2.020 of the Eugene, Code, 1971 authorizes the City Manager to <br />determine and set fees and charges to be imposed by the City for services, goods, use of <br />municipal property, and licenses and permits. <br /> <br />B. In accordance with the procedures, on May 15, 2007, I issued Administrative <br />Order No. 52-07-03 proposing to amend the fees for fire safety and hazardous materials permits <br />that had been established by Administrative Order No. 52-04-03-F on November 15, 2004. A <br />Notice of Intended Amendment of Fees was attached to Administrative Order No. 52-07-03 as <br />Exhibit A, and included the current and proposed fees. <br /> <br />C. Copies of the Notice were sent to the Mayor and City Councilors. Copies of the <br />Notice were also posted at two locations at City Hall on May 29, 2007, and made available for <br />inspection by interested persons at. the office of the City's Fire Marshal, Fire and Emergency <br />Medical Services Department, 1320 Willamette Street, Eugene, Oregon, 97401, during normal <br />business hours (8 am to 5 pm, Monday through Friday, exclusive of holidays). The Notice <br />provided that written comments would be received for a period of 15 days from the date of <br />posting. No written comments were received within the time or in the manner provided in the <br />Notice. <br /> <br />D. Based upon the above findings and the findings in Administrative Order No. 52- <br />07-03, I find that the fees for fire safety and hazardous materials permits should be amended as <br />proposed. Amendment of the fees are necessary so that the fees charged more accurately reflect <br />cost recovery related to the time and materials required to perform reviews, consultations, <br />inspections of events, and the City's increased salary and benefit costs for the employees <br />performing the services. In determining the fees, I have considered the applicable policies, <br />enactments and directives of the City Council, the amount charged for these services by the City <br />in the past, the full costs of providing these services supported by the fees, the amounts charged <br />by other comparable providers, and the revenue needs of the City as determined by the adopted <br />City budget. <br /> <br />On the basis of these findings, I order that: <br /> <br />Administrative Order - 1 <br />C:\Documents and Settings\cefddwp\Local Settings\Temporary Internet Files\OLK2A'-07 fire haz permit fees - 2 ao (00 174840).doc <br />
