<br />ADMINISTRATIVE ORDER NO. 53-08-02-F <br />of the <br />City Manager <br />City of Eugene, Oregon <br /> <br />REPEAL OF ADMINISTRATIVE ORDER NO. 53-07-03-F AND <br />EXTREME FIGHTING ADMINISTRATIVE RULE R-4.740. <br /> <br />The City Manager of the City of Eugene fmds that: <br /> <br />A. Section 2.019 of the Eugene Code, 1971, authorizes the City Manager to adopt <br />rules for administration and implementation of any provisions of that Code. <br /> <br />B. On January 8, 2007, the City Council adopted Ordinance No. 20375 adding <br />Section 4.740 to the Eugene Code, 1971, which prohibited extreme fighting except for matches <br />in which the participants and the promoter complied with rules established by the City Manager. <br /> <br />C. On March 8, 2007, the City Manager issued Administrative Order No. 53-07-03-F <br />adopting Extreme Fighting Administrative Rule R-4.740 which allowed extreme fighting to take <br />place in accordance with that Rule and ensured that appropriate safety measures were in place <br />during extreme fighting matches. <br /> <br />D. In June of 2007, the Oregon Legislature adopted Senate Bill 492, (OR Laws <br />Chapter 585, 2007) which provides that ordinances regulating mixed martial arts adopted by <br />cities and counties before February 1, 2007, may not be enforced once the Superintendent of <br />State Police adopts administrative rules regulating mixed martial arts matches. The definition of <br />"mixed martial arts" contained in SB 492 includes the conduct defined in the Eugene Code as <br />"extreme fighting." <br /> <br />E. On June 13, 2008, the Superintendent of State Police adopted final Oregon <br />Administrative Rules 230-010-000 et seq., regulating mixed martial arts matches. <br /> <br />F. Because the State of Oregon now has sole jurisdiction to regulate: mixed martial <br />arts, including the conduct defined in the Eugene Code as extreme fighting, on July 28, 2008, the <br />City Council adopted Ordinance No. 20416 repealing Section 4.740 of the Eugene Code, 1971, <br />and the provisions prohibiting extreme fighting. <br /> <br />G. Due to the repeal of Section 4.740 of the Eugene Code, 1971, Extreme Fighting <br />Administrative Rule R-4.740 is moot. Therefore, on August 6, 2008, I issued Administrative <br />Order No. 53-08-02 proposing the repeal of Administrative Order No. 53-07-03..F and Extreme <br />Fighting Administrative Rule R-4.740. <br /> <br />H. Notice of the proposed Rule repeal was published in the Register-Guard, a <br />newspaper of general circulation within the City, on August 14, 15, 16, 17, and 18, 2008.
