<br />ADMINISTRATIVE ORDER NO. 21-00-02-F <br />of the <br />City Manager of the City of Eugene <br /> <br />ADOPTION OF APPLICATION FEE FOR <br />REAL PROPERTY COMPENSATION CLAIMS. <br /> <br />The City Manager of the City of Eugene finds as follows: <br /> <br />A. Section 2.020 of the Eugene Code, 1971 authorizes the City Manager to determine <br />and set fees and charges to be imposed by the City for services, goods, use of municipal property, <br />and licenses and permits. <br /> <br />B. In addition thereto, Section 2.045(b) of the Eugene Code, 1971 authorizes the City <br />Manager to establish an application fee to be paid by applicants seeking to file a claim for real <br />property compensation under Sections 2.040 to 2.070 of that Code. <br /> <br />C. Based on the Findings set forth in Administrative Order No. 21-00-02 issued on <br />December 8, 2000, I proposed to adopt an application fee for real property compensation claims as <br />set forth in Exhibit A attached to that Order. <br /> <br />D. Notice of the proposed adoption was published in the Register Guard, a newspaper <br />of general circulation within the City, and posted at two locations at City Hall on December 12, <br />2000. The Notice was also provided to the Mayor and City Councilors and to any persons who had <br />requested such Notice and was made available for inspection by interested persons at the offices of <br />the City's Planning & Development Department, Planning Division, 99 West 1 Oth Avenue, Eugene, <br />Oregon 97401 during normal business hours (9:00 a.m. to 5:00 p.m., Monday through Friday, <br />exclusive of holidays). <br /> <br />E. <br />Notice. <br /> <br />No written comments were received in the time nor in the manner provided for in the <br /> <br />F. Based upon the above findings, which are hereby adopted, and pursuant to the <br />authority contained in Section 2.020 of the Eugene Code, 1971, and Section 2.045(b) of that Code, <br />I find that the proposed fee, which was developed on the basis of estimations of the costs associated <br />with processing applications and evaluating claims under the newly adopted provisions of the <br />Eugene Code, 1971, including salary, benefits, materials, supplies and indirect costs for employees <br />performing the services, are necessary in order to comply with the Council's goal of recovering the <br />cost of providing such services from the beneficiaries thereof. <br /> <br />Administrative Order - 1 <br />
