<br />ORDINANCE NO. 20188 <br /> <br /> <br />AN ORDINANCE ADOPTING THE 2000 HAZARDOUS SUBSTANCE <br />TRACKING INSTRUCTIONS. <br /> <br />The City Council of the City of Eugene finds that: <br /> <br /> <br />A. <br /> Amendment IV to the Eugene Charter of 1976 was adopted at the general election on <br />November 5, 1996 (the Amendment). The Amendment provides in part that hazardous substance <br />A@ <br />users in Eugene shall file an annual materials balance report that lists inputs and outputs of all <br />hazardous substances obtained, used or generated. By Ordinance No. 20112 adopted by the Council <br />and approved by the Mayor on April 6, 1998, and by Ordinance No. 20137 adopted by the Council <br />and approved by the Mayor on December 7, 1998, the City Council adopted the 1998 and 1999 <br />Hazardous Substance Reporting Forms and Instructions, respectively. <br /> <br />B. <br /> The Toxics Board has reviewed the 1998 and 1999 Instructions, and developed the <br />2000 Hazardous Substance Tracking Instructions for reports due April 1, 2001. The 2000 <br />Instructions reflect certain policy refinements made to the reporting requirements by the Board during <br />1999, as well as changes to the program required by House Bill 2431, adopted by the Oregon <br />Legislature in the 1999 legislative session. These are explained on page ii at the beginning of the <br />A@ <br />2000 instruction booklet. <br /> <br />C. <br /> Like the 1998 and 1999 instructions, the 2000 Instructions also include numerous <br />provisions that simply describe explicit provisions of Amendment IV; some interpretations of the <br />Amendment; and some provisions that are necessary to implement the Amendment in a practicable <br />manner but which are not expressly contained in the Amendment. The Toxics Board has <br />recommended that the Council adopt the 2000 Instructions. <br /> <br />D. <br /> The Council approves the 2000 Instructions as being consistent with the terms and <br />intent of Amendment IV and House Bill 2431 adopted by the Oregon Legislature in the 1999 <br />legislative session.
