<br />ADMINISTRATIVE ORDER NO. 58-05-13-F <br />of the <br />City Manager <br /> <br />ADOPTING A REAL PROPERTY <br />PURCHASE APPLICATION FEE <br /> <br />The City Manager of the City of Eugene finds as follows: <br /> <br />A. Sections 2.860 through 2.874 of the Eugene Code, 1971, authorize the City <br />Manager to dispose of real property pursuant to certain enumerated procedures set forth therein. <br /> <br />B. Section 2.020 of the Eugene Code, 1971 authorizes the City Manager to <br />determine and set fees and charges to be imposed by the City for services, goods, use of <br />municipal property, and licenses and permits. Following the procedures set forth therein, on <br />December 14, 2005 Administrative Order No. 58-05-13 was issued notifying the Mayor and City <br />Councilors that I intended to adopt a real property purchase application fee, as set forth in <br />Exhibit A thereto. <br /> <br />C. The Notice was also published in the Register Guard, a newspaper of general <br />circulation within the City and posted at two locations at City Hall on December 23, 2005, and <br />was made available for inspection by interested persons at the offices of the City's Public Works <br />Department, 858 Pearl Street, Eugene, Oregon 97401, during normal business hours (8:00 a.m. <br />to 5:00 p.m. Monday through Friday, exclusive of holidays). The Notice provided that written <br />comments would be received thereon for a period of fifteen days from the date of posting and <br />publication. No comments were received within the time and manner required by the Notice. <br /> <br />D. Based on the above findings, and the findings in Administrative Order No. 58-05- <br />13, I find that the real property purchase application fee as proposed is consistent with applicable <br />policies and directives of the City Council to recover the cost of services from the direct <br />beneficiaries of those services; is necessary in the order to defray the City's costs associated with <br />providing those services, and should be established as proposed. <br /> <br />On the basis of these findings I hereby order that: <br /> <br />1. An application fee in the amount of $1 ,000.00 is hereby established for processing <br />an application for the purchase of City-owned properties that have been declared to be surplus at <br />the request of a prospective purchaser of such property. <br /> <br />2. If the prospective purchaser requesting a declaration of property as surplus and <br />sale of such property is successful and completes the purchase of the property, the application fee <br />will be credited toward the purchase price. Failure to complete the purchase will result in <br />forfeiture of the application fee unless another bidder completes the purchase, in which case the <br /> <br />Administrative Order - 1 <br />
