<br />ADMINISTRATIVE ORDER NO. 58-02-18-F <br />of the <br />City Manager pro tern of the City of Eugene <br /> <br />AMENDMENT OF REGIONAL (MWMC) WASTEWATER <br />SYSTEMS DEVELOPMENT CHARGE (SDC) CREDIT <br />RATES. <br /> <br />The City Manager pro tern of the City of Eugene finds as follows: <br /> <br />A. Section 2.020 of the Eugene Code, 1971 authorizes the City Manager of the City of <br />Eugene to determine and set fees and charges to be imposed by the City for services, goods, use of <br />municipal property, and licenses and permits. Eugene Code 7.71 O( 5) authorizes the City Manager <br />to adopt by administrative order changes to SDC rate factors and cost indices. <br /> <br />B. The SDC Methodology which had been adopted by Administrative Order No.5 8-0 1- <br />11-F, was repealed by Administrative Order No. 58-02-12-F and the SDC Methodologies were <br />adopted by Council Resolution No. 4717. <br /> <br />C. In accordance with the procedures set forth in Sections 2.020 and 7.710(5) of the <br />Eugene Code, 1971, on June 3, 2002, I issued Administrative Order No. 58-02-18 and notified the <br />Mayor and City Councilors that, pursuant to a request by the Metropolitan Wastewater Management <br />Commission (MWMC), I intended to adjust Table 9 (the Regional (MWMC) SDC Credit Rates), <br />which is included in the SDC Methodologies that were adopted by Resolution No.4 71 7, by updating <br />the credit rates to reflect passage of a year as set forth in the Notice of Intended Fees attached as <br />Exhibit A to the Administrative Order. This adjustment is based on a periodic application of <br />previously adopted factors related to rates. <br /> <br />D. Notice was also posted at two locations at City Hall on June 6, 2002, and made <br />available for inspection by interested persons at the office of the City Engineer, Public Works <br />Department, 858 Pearl Street, Eugene, Oregon 97401, during normal business hours (8:00 a.m. to <br />5:00 p.m., Monday through Friday, exclusive of holidays). Notice provided that written comments <br />would be received for a period of 15 days from the date of posting. No comments were received <br />within the time or in the manner set forth in the Notice. <br /> <br />E. I find that Regional (MWMC) Wastewater SDC Credit Rates should be amended as <br />proposed and that the rates set forth in Exhibit A attached hereto are consistent with adopted policies <br />of the City, in conformity with applicable state law, authorized by EC 7.710(5), and should be <br />implemented effective July 1, 2002. <br /> <br />Administrative Order - 1 <br />c:\ WINDOWS\TEMP\A058-02-18Ewpd <br />
