<br />ADMINISTRATIVE ORDER NO. 58-02-12-F <br />of the <br />City Manager pro tern of the City of Eugene <br /> <br />REPEAL OF ADMINISTRATIVE ORDER NO. 58-01-11-F AND THE <br />SYSTEMS DEVELOPMENT CHARGE (SDC) METHODOLOGY ADOPTED <br />THEREIN. <br /> <br />The City Manager pro tern of the City of Eugene finds as follows: <br /> <br />A. The Systems Development Charges (SDC) Methodology was originally adopted by <br />Ordinance No. 19773 on May 13, 1991. That Ordinance provided that all future modifications to <br />the Methodology be made by Administrative Order of the City Manager Pursuant to that provision, <br />subsequent amendments to the SDC Methodology were made by Administrative Order; the most <br />recent amendment occurring on June 29,2001, by Administrative Order No. 58-01-11-F. <br /> <br />B. On April 8, 2002, Ordinance No. 20248 was adopted amending Chapter 7 of the <br />Eugene Code, 1971, to bring the Eugene Code into compliance with the state SDC statutes by <br />clarifying that the process for adopting and amending SDC Methodologies be by Council Resolution <br />or Ordinance, but that adjustments to SDC rate factors and cost indices may be accomplished <br />administratively. Resolution No. 4717 was also adopted on April 8, 2002, which adopted the SDC <br />Methodology attached as Exhibit A thereto. The Resolution also provided that future adjustments <br />to SDC rate factors and cost indices be accomplished by Administrative Order of the City Manager <br />pursuant to Section 2.020 of the Eugene Code, 1971. Both Ordinance No. 20248 and Resolution No. <br />4717 become effective on May 8,2002. <br /> <br />C. In accordance with the amendments indicated above, I issued Administrative Order <br />No. 58-02-12 and notified the Mayor and City Councilors that I intended to repeal Administrative <br />Order No.5 8-01-11- F and the SDC Methodology adopted therein upon the effective date of Council <br />Resolution No. 4717 adopting the SDC Methodologies. <br /> <br />D. Notice was also published in the Register-Guard, a newspaper of general circulation <br />within the City, for five consecutive days, to wit: April 22, 23, 24, 25 and 26, 2002; posted at four <br />public locations on April 22, 2002; and made available for inspection by interested persons at the <br />office of the City Manager, 777 Pearl Street, Room 105, the Human Resource and Risk Services <br />Office, 777 Pearl Street, Room 101, the Public Works Lobby, 858 Pearl Street, and the Eugene <br />Public Library, 100 W 13th Avenue, all in Eugene, Oregon, during normal business hours. The <br />Notice provided that written comments would be received for a period of 15 days from the date of <br />publication and posting.
