<br />ADMINISTRATIVE ORDER NO. 56-01-01-F <br />of the <br />City Manager of the City of Eugene <br /> <br />AMENDMENT OF VEHICLE IMPOUNDMENT NOTICE AND <br />HEARING PROCEDURES ADMINISTRATIVE RULE R-5.695 <br />AND REPEAL OF ADMINISTRATIVE ORDER NO. 58-96-03-F <br /> <br />The City Manager of the City of Eugene finds that: <br /> <br />A. Section 2.019 of the Eugene Code, 1971 authorizes the City Manager to adopt rules <br />deemed necessary for the administration and enforcement of provisions of the Eugene Code, 1971. <br />In addition, Sections 5.695, 5.697 and 5.698 of that Code specifically authorize the City Manager <br />to adopt rules that provide for the manner of providing notice of vehicle impoundment and <br />establishing procedures for hearings related to such actions. <br /> <br />B. Pursuant to that authority, Vehicle Impoundment Notice and Hearing Procedures <br />Administrative Rule R-5.695 was adopted on February 7, 1996. Vehicles are subject to being <br />impounded under provisions of the Eugene Code, 1971 and state law. Based on recent changes to <br />state law, staff has recommended that Rule R-5.695 be amended. <br /> <br />C. On December 21,2001, the City Manager issued Administrative Order No. 56-01- <br />01, proposing that Administrative Order No. 58-96-03-F be repealed, and Rule R-5.695 be amended <br />to (1) delete the requirement of mailing notice prior to impoundment of vehicles that are stored on <br />the street and provide that notice be given at the time the citation is issued; and (2) add provisions <br />relating to notice requirements for vehicles impounded under authority ofORS 809.720. <br /> <br />D. Notice of the proposed amendment was published in the Register-Guard, a newspaper <br />of general circulation within the City, for five consecutive days, to wit: December 27, 28, 29,30 <br />and 31, 2001, and made available to any person who had requested such notice. <br /> <br />E. The Notice provided that written comments would be received for a period of 15 days <br />from the date of the first publication. No comments were received within the time or in the manner <br />provided in the Notice. <br /> <br />Based upon the above findings, which are hereby adopted, and pursuant to the authority <br />contained in Sections 2.019,5.695,5.697 and 5.698 of the Eugene Code, 1971, I hereby Repeal <br />Administrative Order No. 58-96-03-F as of the effective date of this Order, and adopt Vehicle <br />Impoundment Notice and Hearing Procedures Administrative Rule R-5.695 to provide as follows: <br /> <br />Administrative Order - 1 <br />c:\ WINDOWS\ TEMP\O 1 impr12ao. wpd <br />
