<br />ADMINISTRATIVE ORDER NO. 53-06-01 <br />of the <br />City Manager <br />City of Eugene, Oregon <br /> <br />DELEGATING RENTAL HOUSING CODE DUTIES. <br /> <br />The City Manager of City of Eugene finds that: <br /> <br />A. Under the provisions of Chapter IV, Section 16 of the Eugene Charter of 2002 <br />("Charter"), the City Manager is designated as the administrative head of the City, and is <br />specifically authorized to appoint and remove all employees (except as otherwise provided in the <br />Charter), and to enforce all ordinances of the City. Section 2.019 of the Eugene Code, 1971 <br />("EC") authorizes the City Manager to adopt rules for administration and implementation of any <br />provisions of the Code. EC 8.430 further authorizes the City Manager to enforce all of the <br />Rental Housing Code provisions ofEC 8.400 through 8.440. <br /> <br />B. Pursuant to the above authority, the City Manager issued Administrative Order <br />No. 53-05-02-F on July 7, 2005, adopting Rental Housing Code Administrative Rule R-8.430 <br />("R-8.430"), which provides for administration of the Rental Housing Code provisions. <br /> <br />C. I find that it would be more efficient in administering the City's Rental Housing <br />Code Regulations to delegate my duties, responsibilities and authority under EC 8.400 through <br />8.440, and R-8.430 as set forth in this Order. <br /> <br />Based on the above fmdings, the City Manager of the City of Eugene orders that: <br /> <br />1. The above findings are adopted. <br /> <br />2. My duties, responsibilities and authority contained in the provisions of EC 8.400 <br />through 8.440, and R-8.430, are delegated to the Building Official, with the Code Enforcement <br />Supervisor and the Code Enforcement Inspectors performing such duties as authorized by the <br />Building Official. <br /> <br />3. The delegated authority does not include: <br /> <br />a. The adoption, amendment, or repeal of any rules authorized in R-8.430; <br /> <br />b. The adoption, amendment, or repeal of any fees or fee schedules <br />authorized in R-8.430; <br /> <br />c.
