ADMINISTRATIVE aRDER N(~. 44-10-02-F <br />AMENDMENT (]F NOTARY SERVICE FEES AND REPEAL 4F <br />ADMINISTRATIVE ORDER N~. 44-92-05. <br />The City Manager of the City of Eugene finds that: <br />A. Section 2.020 of the Eugene Code, 1971, authorizes the City Manager to <br />determine and set fees and charges to be imposed by the City for services, goods, use of <br />municipal property, and licenses and permits. <br />B. Under Section 194.164 of the Oregon Revised Statutes, Notaries ~ Public may <br />charge fees for performing notarial acts. Oregon Administrative Rule SOAR} 160-100-0400 set <br />the maximum fees that notaries public may charge for performing notarial acts. <br />C. City employees who are notaries have entered into letters of agreement with the <br />City far the performance of employment-related notarial duties for which no fees are char ed. <br />g <br />On August 11, 1992, Administrative Order No. 44-92-05 was adopted establishing fees for <br />notarial services by City employees when those services are performed for members of the <br />public by City employees during working hours and are not related to, nor required b , Ci <br />Y tY <br />procedures, The notary fees did not exceed those set out in OAR 160-100-0400. <br />D, OAR 160-100-0400 has recently been amended increasing the maximum amount <br />of notary fees .permitted to be charged, <br />E. On March S, 2010, I issued Administrative Order No. 44w 10-02, proposing to <br />amend the Notary Services Fee Schedule established by Administrative Order No. 44-92-OS due <br />to the amendment of OAR 160-100-0400. Notice of the proposed amendments was provided to <br />the Mayor and City Councilors and was made available ~ for review by interested persons at the <br />City's Manager's Office, 777 Pearl Street, Room 105, Eugene, Ore on, 97401, durin normal <br />., g g <br />business hours. In addition, on March 11, 2010, the Notice was posted at two locations at City <br />Hall. <br />F. The Notice provided that comments would be received for 15 days from the date <br />of posting. No comments were received within the time or in the manner described in the <br />Notice. <br />G. Based on the above findings, the Notary Services Fee Schedule should be <br />amended as proposed in order to compensate the City for interruption of City employees' regular <br />duties while performing notarial acts. In determining the fees, I have considered applicable <br />policies, enactments and directives of the council; the amount charged by the city in the past; the <br />full costs of providing the service supported by the fee; the amounts charged by other <br />comparable providers; and the revenue needs of the city as determined b the ado ted cit <br />Y p Y <br />budget. <br />Administrative Order -Page 1 of 2 <br />
