ADMINISTRATIVE ORDER NO. 21-11-01 <br />of the City Manager <br />DELEGATING TO THE CITY ATTORNEY THE AUTHORITY TO <br />ACCEPT OR REJECT REQUESTS FOR DEFENSE AND <br />INDEMNIFICATION. <br />The City Manager of the City of Eugene finds that: <br />A. Under the provisions of Chapter IV, Section 16 of the Eugene Charter of 2002, <br />the City Manager is designated - as the administrative head of the City, and is specifically <br />authorized to appoint and remove all employees (except as otherwise provided in the Charter), <br />and to enforce all ordinances of the City. <br />B. The City of Eugene has a legal responsibility to defend and indemnify its officers, <br />agents and employees to the extent prescribed by ORS 30.285 and 30.287. When an officer, <br />agent or employee receives notice of a tort claim or demand for which he/she may be entitled to <br />defense or indemnity, and that person files a written request for defense and indemnification <br />through Risk Services, it is my responsibility to accept or reject such requests, and to notify the <br />employee and Risk Services of my determination. <br />C. I find it would be more efficient and in the public interest to delegate to the City <br />Attorney my duties and responsibilities to accept or reject requests for defense and <br />indemnification. <br />NOW, -THERFORE, <br />The City Manager of the City of Eugene Orders and Directs that: <br />1. The above findings are adopted. <br />2. The City Attorney is authorized to carry out the following duties with respect to <br />employee requests. for defense and indemnification: <br />a. Review Risk Services' investigation, findings and recommendation <br />regarding requests for defense and indemnification; <br />b. Accept or reject requests in accordance with ORS 30.285 and 30.287; <br />C.
