ADMINISTRATIVE ORDER NO. 21-03-12 <br /> of the <br /> City Manager <br /> City of Eugene, Oregon <br /> <br /> RESCINDING ADMINISTRATIVE ORDER NO. 58-92-21 AND <br /> RE-DELEGATING DUTIES TO THE EXECUTIVE <br /> DIRECTOR OF THE PUBLIC WORKS DEPARTMENT. <br /> <br /> The City Manager of the City of Eugene finds that: <br /> <br /> A. Under the provisions of Chapter IV, Section 16 of the Eugene Charter of 1976, the <br />City Manager was designated as the administrative head of the City, was specifically authorized to <br />appoint and remove all employees (except as otherwise provided in the Charter), organize, disband, <br />or reorganize City departments, and to enforce all ordinances of the City. (The same authorizations <br />are contained in Chapter IV, Section 16 of the Eugene Chaxter of 2002, subject to the limitations <br />contained therein.) Pursuant to that authority, in 1992 the City Manager reorganized the Public <br />Works Department and Parks, Recreation and Cultural Services Department (PARCS), with many <br />of the functions, duties and responsibilities previously performed by the PARCS Department <br />becoming the function, duty or responsibility of the Public Works Department. <br /> <br /> B. At that time Sections 2.812 to 2.817 of the Eugene Code, 1971 (ECL authorized or <br />required specific duties or acts to be performed by the person designated by the City Manager as the <br />Executive Director of the Parks, Recreation and Cultural Services Department, and EC Section 4.330 <br />authorized the City Manager or designee to designate areas within City parks where dogs may be <br />allowed to run off leash. <br /> <br /> C. On November 30, 1992 the CityManager issued Administrative Order No. 58-92-21 <br />designating the Executive Director of the Public Works Department as the person to carry out the <br />duties and responsibilities referenced in finding B above, and rescinding any prior orders in conflict <br />therewith. <br /> <br /> D. Although EC Sections 2.812 to 2.817 were repealedbyOrdinance No. 20015 onMay <br />22, 1995, subsequent administrative orders of the City Manager have confirmed the continuing <br />authority delegated by Administrative Order No. 58-92-21. <br /> <br /> E. Due to the passage of time and the limitations on access to EC Sections 2.812 to <br />2.817, the a~Ithority delegated in Administrative Order No. 58-92-21 should be reaffirmed and the <br />duties and responsibilities re-delegated as set forth herein, with that order rescinded as of the <br />effective date of this Administrative Order. <br /> <br /> Now, therefore, based upon the above findings, which are hereby adopted, <br /> <br /> The City Manager of the City of Eugene orders and directs that: <br /> <br /> 1. Administrative Order No. 58-92-21, is hereby rescinded, as of the effective date of <br />this Administrative Order. <br /> <br /> 2.
