ADMINISTRATIVE ORDER NO. 58-11-01-F <br />of the <br />City Manager of the City of Eugene <br />INFLATIONARY ADJUSTMENT OF SYSTEMS DEVELOPMENT <br />CHARGES FOR LOCAL WASTEWATER SYSTEM, <br />TRANSPORTATION SYSTEM, AND STORMWATER SYSTEM; AND <br />REPEALING ADMINISTRATIVE ORDER NO. 58-08-02-F-0 <br />The City Manager of the City of Eugene fords as follows: <br />A. Section 2.020 of the Eugene Code, 1 971, authorizes the City Manager of the City <br />of Eugene to determine and set fees and charges to be imposed by the City for services, goods, <br />use of municipal property, and licenses and permits. Section 7.710(5) of that Code authorizes the <br />City Manager to adopt by administrative order inflationary adjustments to Systems Development <br />Charges (SDC) based on previously adopted rate factors and cost indices. Section 2.4 of the <br />SDC Methodologies authorizes the City Manager to adopt fee changes, based on a cost index or <br />rate factors, by administrative order pursuant to Section 2.020 of the Eugene Code, 1971, so long <br />as the fees are not revised administratively in an amount greater than five percent within any 12- <br />month period. <br />B. The SDC Methodologies were adopted by Resolution No. 4900 on April 9, 2007, <br />and have subsequently been amended, most recently by Resolution No. 4998, which became <br />effective on April 1, 2010. <br />C. SDCs for Local Wastewater System, Stormwater System, and Transportation <br />System were adjusted for inflation by Administrative Order No. 58- 08 -02 -F, effective April 3, <br />2008; however, that Administrative Order has been superseded by Resolution No. 4998 which <br />adopted inflationary adjustments to SDCs for . Parks System, Local Wastewater System, <br />Stormwater System, and Transportation System. <br />D. In accordance with the procedures set forth in Sections 2.020 and 7.710(5) of the <br />Eugene Code, 1971, on March 3, 2011, I issued Administrative Order No. 58 -11 -01 proposing to <br />implement a 3.5% inflationary increase to the Local Wastewater System, Transportation System, <br />and Stormwater System as shown on Exhibit A to that Order. The proposed inflationary <br />adjustments were based on the 20 -city national average Construction Cost Index as published by <br />the Engineering News- Record and will not result in a five percent or greater fee revision within a <br />12 -month period. <br />E. Notice of the - proposed inflationary adjustments was given by providing an <br />informational memo to the Mayor and Council and making copies of Administrative Order No. <br />58- 11 -01, including Exhibit A (the proposed amendments) and Exhibit B (the Notice) available <br />for inspection by the Mayor and City Councilors and by interested persons at the office of the <br />City Engineer, Public Works Department, 99 E.
