ADMINISTRATIVE ORDER NO, 55- 11 -04 -F <br />of the <br />City Manager of the City of Eugene <br />AMENDMENT OF THE INDUSTRIAL PRETREATMENT PROGRAM <br />FEES AND REPEAL OF ADMINISTRATIVE ORDER NO. 58-02-11-Fe <br />The City Manager of the City of Eugene finds as follows: <br />A. Sections 2.020 and 6.546 of the Eugene Code, 1971, authorize the City Manager <br />of the City of Eugene to determine and set fees and charges to be impesed by the City for <br />services, goods, use of municipal property, and licenses and permits, and specifically charges <br />and fees to be paid by the industrial users of the City wastewater system who are subject to the <br />provisions of Sections 6.501 to 6.596 of the Eugene Code; 1971. <br />B. In accordance with the procedures set forth above, Administrative Order No. 58- <br />02-1 I-F was issued on April 19, 2002, establishing the Industrial Pretreatment Program Fee <br />Schedule. On June 7, 2011, I issued Administrative Order No. 58 -11 -04 proposing to amend the <br />annual discharge permit fee contained in the Industrial Pretreatment Program Fee Schedule. The <br />current fee and proposed fee were set forth in the Notice of Intended .Amendment attached to <br />Administrative order No. 58- 11--04 as Exhibit A. <br />C. Notice was provided to the Mayor and City Councilors, made available to persons <br />who had requested such notice, and was made available - for inspection by interested persons at <br />the City Manager's office, 777 Pearl Street, Room 105, Eugene, Oregon, 97401, during normal <br />business hours. The Notice was also posted at two locations at City Hall and published in the <br />Register -guard Newspaper on June 17,, 2011. The Notice provided that written comments would <br />be received for a period of 15 days from the date of publication and posting. No comments were <br />received within the time or in the manner provided in the Notice. <br />- D. I find that the Industrial Pretreatment Program -Fee Schedule should, be amended <br />as proposed. In determining the fees, I have considered the, applicable policies, enactments and <br />directives of the City Council, the amount charged for these services by the City in the past, the <br />full costs of providing these services supported by the fees, the amounts charged by other <br />comparable providers,' and the revenue needs of the City as determined by the adopted City <br />budget. In. addition, Section 6.546 of the Eugene Code, 1971, requires that fees be established to <br />reduce the City's cost of providing set u and operation of the pretreatment program; sampling, y p g p . <br />monitoring, inspections and surveillance procedures; review of accidental discharge procedures <br />and control; and review of and acting upon permit applications. <br />On the basis of these findings, I order that: <br />11 The fees set forth in Exhibit A hereto are the fees to be charged for the described <br />services as of the effective date of this order. <br />Administrative order - Page 1 - of 2 <br />
