ADMINISTRATIVE ORDER NO. 57- 12 -01 -F <br />of the <br />Library, Recreation & Cultural Services Department <br />AMENDMENT OF THE CUTHBERT AMPHITHEATER HOUSE RULES <br />AND REPEAL OF ADMINISTRATIVE ORDER NOS. 57- 97 -02 -F AND 57- <br />11-05. <br />The Executive Director of the Library, Recreation & Cultural Services Department <br />(LRCS) of the City of Eugene finds that: <br />A. Pursuant to the authority in Section 2.019 of the Eugene Code, 1971, and the <br />authority delegated to the Executive Director of the Library, Recreation & Cultural Services <br />Department by Administrative Order No. 57- 95 -01, on August 13, 1997, Administrative Order <br />No. 57- 97 -02 -F was issued adopting the Cuthbert Amphitheater House Rules. <br />B. On September 22, 2011, I issued Administrative Order No. 57 -11 -05 which <br />temporarily amended Cuthbert Amphitheater House Rule 1.015 to allow the Executive Director <br />to designate to other City employees the authority to issue notices of restriction of use. That <br />Order will expire on March 20, 2012. <br />C. On February 15, 2012, I issued Administrative Order No. 57 -12 -01 proposing to <br />amend the Cuthbert Amphitheater House Rules to make the temporary amendment to Rule 1.015 <br />a permanent amendment. In addition, I proposed clarifying the boundaries of the concert zone <br />(Rule 1.005), and clarifying which animals are prohibited from the Cuthbert Amphitheater (Rule <br />1.020). <br />D. Notice of the proposed amendments was given by making copies of the Notice <br />attached to Administrative Order No. 57 -12 -01 as Exhibit A available to any person who had <br />requested such notice, and to any business which possessed a license issued pursuant to the Rule, <br />and by publication of the Notice in the Register Guard Newspaper on February 17, 18, 19, 20, <br />and 21, 2012. The Notice provided interested persons an opportunity of 15 days to submit data <br />or comments on the amendments. <br />E. One comment was received in response to the Notice. A summary of the <br />comment along with my response to the comment follows: <br />Comment Twila Butler submitted a letter indicating that she strongly opposes <br />allowing dogs or other animals at the Cuthbert. <br />Findings Staff contacted Ms. Butler by telephone and confirmed that Ms. Butler <br />had misunderstood the proposed change. Staff clarified with Ms. Butler that only service <br />animals would be allowed at the Cuthbert. No changes are being made to the proposed <br />Rules as a result of this comment. <br />Administrative Order - Page 1 of 6 <br />
