ADMINISTRATIVE ORDER NO. 58-12-03-F <br />of the <br />City Manager of the City of Eugene <br />AMENDMENT OF THE STORMWATER USER FEE SCHEDULE AND <br />REPEAL OF ADMINISTRATIVE ORDER NO. 58-11-02-F. <br />The City Manager of the City of Eugene finds as follows: <br />A. Section 6.411 of the Eugene Code, 1971, authorizes the City Manager to <br />determine and set fees and charges to be imposed by the City for wastewater service, regional <br />wastewater service, and stormwater service. Pursuant to that authority, on May 2, 2011, I issued <br />Administrative Order No. 58- 11 -02 -F amending the Stormwater User Fee Schedule, which <br />became effective and final on May 13, 2011, for bills issued on or after July 1, 2011. <br />B. In accordance with the provisions of EC 6.411, on April 5, 2012, I issued <br />Administrative Order No. 58- 12 -03, proposing to amend the Stormwater User Fee Schedule that <br />had been established by Administrative Order No. 58- 11 -02 -F. The current and proposed <br />stormwater user fees were set out in the Notice attached as Exhibit A to Administrative Order <br />No. 58- 12 -03: The Notice also provided that written comments would be received for a period <br />of ten days from the first date of publication and posting, and that comments would also be <br />received at the public hearing held in the Public Works Engineering Les Lyle conference room, <br />99 E. Broadway, 0 floor, Eugene, Oregon, 97401, on April 25, 2012, at 2 p.m. <br />C. The Notice was provided to the Mayor and City Councilors, the news media, any <br />person who had requested such notice, and to interested governmental agencies (including the <br />United States Environmental Protection Agency, the Department of Environmental Quality, <br />MWMC, and the Eugene Water & Electric Board), and was made available for inspection by <br />interested persons at the offices of the Public Works Department, 101 E. Broadway, Suite 400, <br />Eugene, Oregon, 97401, during normal business hours. In addition, the Notice was posted at two <br />locations at City Hall on April 13, 2012, and published in the Register Guard Newspaper on <br />April 14 and 15, 2012. <br />D. No comments were received within the time or in the manner provided in the <br />Notice, and no one attended or testified at the public hearing. <br />E. Pursuant to EC 6.411 (1), the amended charges were determined after conducting <br />an investigation of the revenue needs of the City in providing the stormwater services. Based on <br />that investigation and the criteria set out in EC 6.411(2), I find that the amended Stormwater <br />User Fee Schedule attached as Exhibit A should be implemented and effective for all bills issued <br />on or after July 1, 2012. <br />Administrative Order -- Page 1 of 2 <br />
