<br /> <br />ECC <br />UGENE ITY OUNCIL <br />AIS <br />GENDA TEM UMMARY <br /> <br /> <br /> <br /> <br />Action: Approval of Findings and Recommendations from the Hearings Official and <br />Adoption of an Ordinance Levying Assessments for Improvements Consisting of Paving, <br />Curbs and Gutters, Sidewalks, and Storm Water Drainage System on Debrick Road from <br />Clinton Drive to Valley Butte Drive, and Butte Lane from Clinton Drive to 700 feet <br />south; and Providing an Immediate Effective Date (Contract 2006-05) (Job #4111) <br /> <br /> <br />Meeting Date: May 8, 2006 Agenda Item Number: 3 <br />Department: Public Works-Engineering Staff Contact: Paul Klope <br />www.eugene-or.gov Contact Telephone Number: 682-5246 <br /> <br /> <br /> <br /> <br />ISSUE STATEMENT <br /> <br />City Council is being asked to approve the Hearing Official’s Findings and Recommendations dated <br />April 24, 2006, and adopt an ordinance levying assessments for improvements consisting of paving, <br />curbs and gutters, sidewalks, and storm water drainage system on Debrick Road from Clinton Drive to <br />Valley Butte Drive, and Butte Lane from Clinton Drive to 700 feet south. <br /> <br />Please note: This item has an immediate effective date. An immediate effective date requires a 2/3 <br />majority or six affirmative votes from the council to enact. Ordinances without an immediate <br />effective date do not take effect for 30 days. Without an immediate effective date, an additional 30 <br />days of interest expense will accrue. <br /> <br /> <br />BACKGROUND <br /> <br />The project design and bidding was initiated as a result of a Poll Petition by the City in November 2003. <br />The petition requesting the local improvement district was signed by property owners who represent <br />71% of the assessable frontage within the boundaries of the proposed Local Improvement District (LID). <br />The City Engineer initiated the preparation of plans and specifications, pursuant to Section 7.160(8) of <br />the Eugene Code, 1971 on February 20, 2004. The project has brought Debrick Road up to full City <br />standards and meets the current and future pedestrian, bicycle and vehicular needs. <br />Bids were opened on June 21, 2005, with Babb Construction Co. dba Delta Construction Co. as the low <br />bidder. Property owners were notified of a public hearing regarding formation of the proposed LID and <br />the public hearing was held on June 23, 2005. The City Council passed a resolution forming the Local <br />Improvement District (LID) on July 18, 2005. Construction of the project has been completed, final <br />actual costs have been tabulated, and final assessment costs have been calculated. <br /> <br />Based on the low bid received, the costs listed below were the estimated assessment costs calculated at <br />the time of the formation of the LID. <br /> <br /> <br /> L:\CMO\2006 Council Agendas\M060508\S0605083.doc <br />
