requesting the substance be added to the list as a characteristic chemical. The <br />recommendation will include the reason for the recommended addition. <br />a. If the Toxics Board rejects the request, the Toxics Board will notify the business <br />representative in writing the reason for rejection, and the chemical shall not be <br />reportable. <br />3. The City Manager may then either accept or reject the Toxics Board's recommendation <br />for inclusion of the substance. <br />4. If the City Manager agrees to include the chemical on the List of Reportable Chemicals, <br />the City Manager will establish a date when the additional chemical shall be subject to <br />the materials balance reporting requirements. <br />a. If the City Manager rejects the recommendation, the City Manager will notify the <br />Toxics Board in writing the reason for rejection, and the chemical shall not be <br />reported. <br />"Chemical Category" substances In the list of reportable substances, a number of chemical <br />categories are listed. They are designated by "N" followed by a three -digit number, rather than a <br />CAS number. These categories are defined in SARA 313 (EPCRA), and chemicals included in <br />the listed categories are reportable under Eugene's Toxics Right -to -Know law. <br />A Safety Data Sheet (SDS) will often be helpful in determining whether you are working with <br />Chemical Category substances. This information may appear on the list of hazardous ingredients <br />on the SDS, and /or under "Regulatory Information," where one or more chemicals may be listed <br />without a CAS number, but as reportable under SARA 313. <br />Chemicals listed federally without CAS numbers The Toxics Board has identified a small <br />number of chemicals or groups of chemicals that appear on the federal lists that comprise the <br />Eugene list of reportable substances, but that do not have CAS numbers. These appear on the list <br />with the designation "TB" followed by a number. They are reportable in the same manner as <br />other reportable chemicals. <br />Table of Special Designations <br />-13- <br />The generic designations CI through C7 indicate chemicals whose <br />identity (CAS number) is not known to the reporting business, but <br />C <br />which are known to possess one or more of the characteristics of <br />hazardous waste as defined in 40 CFR Part 261, Subpart C <br />(Appendix D). <br />The N designation (followed by a three -digit number) indicates <br />N <br />chemical categories listed as reportable in SARA 313. They <br />include any compound that contains the listed chemical as part <br />of its infrastructure. <br />If an SDS lists a substance as reportable under SARA 313 or SARA <br />SG <br />302, but does not identify the chemical because it is a trade secret of <br />the supplier, the chemical may be reported as SG. <br />-13- <br />
